STATE OF NEW YORK ________________________________________________________________________ 4473--A 2015-2016 Regular Sessions IN SENATE March 23, 2015 ___________ Introduced by Sens. LAVALLE, LARKIN -- read twice and ordered printed, and when printed to be committed to the Committee on Education -- recommitted to the Committee on Higher Education in accordance with Senate Rule 6, sec. 8 -- committee discharged, bill amended, ordered reprinted as amended and recommitted to said committee AN ACT to amend the education law, in relation to certain candidates seeking an initial teaching certificate The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Section 3004 of the education law is amended by adding a 2 new subdivision 7 to read as follows: 3 7. Notwithstanding any law, rule or regulation to the contrary, and 4 for candidates seeking an initial teaching certificate on or after May 5 first, two thousand fifteen, but prior to May first, two thousand eigh- 6 teen, the commissioner is authorized and directed to develop at least 7 one alternative pathway to initial certification for candidates that 8 fail to attain a passing score on the teacher performance assessment 9 (edTPA), academic literacy skills test (ALST), or educating all students 10 (EAS) exam. Such pathway may include, but not be limited to, the 11 successful completion of additional coursework, an alternative exam, a 12 conditional certificate contingent on the candidate signing an agreement 13 to complete additional requirements as specified by the commissioner, or 14 any combination thereof. The commissioner shall develop such pathway or 15 pathways within sixty days of the effective date of this subdivision. 16 § 2. This act shall take effect immediately and shall be deemed to 17 have been in full force and effect on and after May 1, 2015, provided 18 that the commissioner of education is authorized to promulgate emergency 19 regulations necessary for the implementation of this act.
