SAMPSON -- read twice and ordered printed, and when printed to be committed to the Committee on Codes AN ACT to amend the penal law, in relation to increasing the penalties for identity theft crimes THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: 1 Section 1. The closing paragraph of section 190.78 of the penal law, 2 as added by chapter 619 of the laws of 2002, is amended to read as 3 follows: 4 Identity theft in the third degree is a class [A misdemeanor] E 5 FELONY. 6 S 2. The closing paragraph of section 190.79 of the penal law, as 7 added by chapter 619 of the laws of 2002, is amended to read as follows: 8 Identity theft in the second degree is a class [E] D felony. 9 S 3. The closing paragraph of section 190.80 of the penal law, as 10 added by chapter 619 of the laws of 2002, is amended to read as follows: 11 Identity theft in the first degree is a class [D] C felony. 12 S 4. This act shall take effect on the ninetieth day after it shall 13 have become a law. EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted. LBD09096-01-5
