       Introduced  by  Sens.  MAZIARZ, ALESI, HANNON, LARKIN, LIBOUS, NOZZOLIO,
         RANZENHOFER, ROBACH, STEWART-COUSINS -- read twice and ordered  print-

       AN ACT to amend the public authorities law, in relation to the eligibil-
         ity of independent institutions of higher education to receive assist-
         ance from the New York power authority in  establishing  energy  effi-
         ciency and clean energy initiatives
         THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section 1. Paragraph (a) of subdivision 16  of  section  1005  of  the
    2  public  authorities law, as added by chapter 477 of the laws of 2009, is
    3  amended to read as follows:
    4    (a) As deemed feasible and advisable by the trustees, to  finance  and
    5  design, develop, construct, implement, provide and administer energy-re-
    6  lated  projects,  programs and services for any public entity, ANY INDE-
    7  PENDENT NOT-FOR-PROFIT INSTITUTION OF HIGHER EDUCATION WITHIN THE STATE,
    8  and any recipient of the economic development  power,  expansion  power,
    9  replacement power, preservation power, high load factor power, municipal
   10  distribution  agency power, and the power for jobs programs administered
   11  by the authority. In establishing and  providing  high  performance  and
   12  sustainable  building  programs and services authorized by this subdivi-
   13  sion, the authority is  authorized  to  consult  standards,  guidelines,
   14  rating  systems,  and/or criteria established or adopted by other organ-
   15  izations, including but not limited to the United States green  building
   16  council  under  its leadership in energy and environmental design (LEED)
   17  programs, the green building initiative's green  globes  rating  system,
   18  and the American National Standards Institute. The source of any financ-
   19  ing  and/or  loans  provided  by  the authority for the purposes of this
   20  subdivision may be the proceeds of notes issued pursuant to section  one
   21  thousand  nine-a of this title, the proceeds of bonds issued pursuant to

    1  section one thousand ten of this title, or any other available authority
    2  funds.
    3    S  2.  This act shall take effect immediately; provided, however, that
    4  the amendments to subdivision 16 of section 1005 of the public  authori-
    5  ties law made by section one of this act shall not affect the expiration
    6  of such subdivision and shall be deemed to expire therewith.
