         RATE, SAVINO -- read twice and ordered printed, and when printed to be
         committed to the Committee on Health
       AN  ACT  to  amend  the  public  health  law,  in  relation to access to
         prescription drug coverage
         THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section  1.  The  public health law is amended by adding a new section
    2  2804-b to read as follows:
    3    S 2804-B. RESIDENTIAL HEALTH CARE FACILITIES; ACCESS  TO  PRESCRIPTION
    4  DRUG  COVERAGE  UNDER  THE  ELDERLY  PHARMACEUTICAL  INSURANCE  COVERAGE
    5  PROGRAM. A RESIDENTIAL HEALTH CARE FACILITY SHALL ENSURE THAT A RESIDENT
    6  WHO IS ENROLLED IN THE ELDERLY PHARMACEUTICAL INSURANCE COVERAGE PROGRAM
    7  (EPIC) UNDER TITLE THREE OF ARTICLE TWO OF THE ELDER LAW SHALL HAVE  THE
    8  OPPORTUNITY  TO  ACCESS  PRESCRIPTION  DRUG  COVERAGE UNDER EPIC FOR ANY
    9  COVERED DRUGS, AS DEFINED IN SUBDIVISION  ONE  OF  SECTION  TWO  HUNDRED
   10  FORTY-ONE OF THE ELDER LAW, DISPENSED TO THE RESIDENT BY THE RESIDENTIAL
   11  HEALTH CARE FACILITY.
   12    S  2. This act shall take effect on the first of January next succeed-
   13  ing the date on which it shall have become a law.
