       AN  ACT  to amend the retirement and social security law, in relation to
         forfeiture of pension rights or retirement benefits upon conviction of
         a felony related to public employment
         THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section  1.  Subdivision 1 of section 157 of the retirement and social
    2  security law, as added by section 1 of part C of chapter 399 of the laws
    3  of 2011, is amended to read as follows:
    4    1. Notwithstanding any other law to the contrary, it shall be  a  term
    5  and  condition  of  membership  for every public official [who becomes a
    6  member of any retirement system on or after the effective  date  of  the
    7  chapter  of  the  laws of two thousand eleven which added this article,]
    8  that such public official's rights to a pension in a  retirement  system
    9  that  accrue  in such retirement system after his or her date of initial
   10  membership in the retirement system shall be subject to  the  provisions
   11  of this article.
   12    S 2. This act shall take effect immediately.
