       Introduced  by  Sen.  GRIFFO -- read twice and ordered printed, and when
         printed to be committed to the Committee on  Energy  and  Telecommuni-
         cations -- reported favorably from said committee and committed to the
         Committee  on  Finance  -- committee discharged, bill amended, ordered
         reprinted as amended and recommitted to said committee
       AN ACT to amend the public service law, in relation to providing consum-
         ers the option to elect not to use transmitting utility meters
         THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section  1.  The public service law is amended by adding a new section
    2  67-b to read as follows:
    3    S 67-B. TRANSMITTING UTILITY METER; ELECTION NOT TO USE. NOTWITHSTAND-
    4  ING ANY OTHER PROVISION OF LAW, THE COMMISSION IS AUTHORIZED TO  PROVIDE
    5  THAT  CONSUMERS  MAY ELECT NOT TO USE TRANSMITTING UTILITY METERS OF ANY
    6  INVESTOR OWNED ELECTRIC LIGHT AND POWER COMPANY SUBJECT TO REGULATION BY
    7  THE COMMISSION; PROVIDED, HOWEVER, THAT THE COMMISSION SHALL NOT  CREATE
    8  AND  REGULATE  A  SURCHARGE FOR CONSUMERS WHO MAKE SUCH AN ELECTION. FOR
    9  PURPOSES OF THIS SECTION, THE TERM "TRANSMITTING UTILITY METER" MEANS AN
   10  ELECTRIC METER THAT IS CAPABLE  OF  RECORDING  CONSUMPTION  OF  ELECTRIC
   11  ENERGY  AND  COMMUNICATING  SUCH  INFORMATION UTILIZING TWO-WAY COMMUNI-
   12  CATION BETWEEN THE METER AND THE ELECTRIC SUPPLIER  FOR  MONITORING  AND
   13  BILLING PURPOSES.
   14    S 2. This act shall take effect immediately.
