        Introduced  by Sens. FUNKE, RANZENHOFER -- read twice and ordered print-
          ed, and when printed to be  committed  to  the  Committee  on  Racing,
          Gaming and Wagering
        AN ACT to amend the general municipal law, in relation to allowing alco-
          holic beverages as prizes in any game of chance
          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
     1    Section 1. Section 195-d of the general municipal law, as  amended  by
     2  section  13  of part MM of chapter 59 of the laws of 2017, subdivision 3
     3  as amended by chapter 464 of the laws of 2017, is  amended  to  read  as
     4  follows:
     5    §  195-d.  Charge  for  admission and participation; amount of prizes;
     6  award of prizes. 1. A fee may be charged by any licensee  for  admission
     7  to  any game or games of chance conducted under any license issued under
     8  this article. The clerk or department may in its discretion fix a  mini-
     9  mum fee.
    10    2.  With the exception of bell jars, coin boards, seal cards, merchan-
    11  dise boards and raffles, every winner  shall  be  determined  and  every
    12  prize  shall  be  awarded  and delivered within the same calendar day as
    13  that upon which the game was played. [No  alcoholic  beverage  shall  be
    14  offered or given as a prize in any game of chance.]
    15    3.  A  player  may  purchase  a chance with cash or, if the authorized
    16  organization wishes, with a personal check, credit card or debit card.
    17    § 2. Subdivision 3 of section 190-a of the general municipal  law,  as
    18  added by chapter 400 of the laws of 2005, is amended to read as follows:
    19    3.  No  person  under  the age of eighteen shall be permitted to play,
    20  operate or assist in any raffle  conducted  pursuant  to  this  section.
    21  Where any such raffle awards a prize containing alcohol, no person under
    22  the  age  of twenty-one shall be permitted to play, operate or assist in
    23  such raffle conducted pursuant to this section.
    24    § 3. This act shall take effect immediately.
