        AN ACT to amend the legislative law, in relation to freezing  per  diems
          for  legislators  with secondary incomes exceeding 20 percent of their
          legislative salaries
          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
     1    Section 1. Paragraph (a) of subdivision 2 of section 5 of the legisla-
     2  tive  law, as added by section 7 of part CC of chapter 56 of the laws of
     3  2015, is amended to read as follows:
     4    (a) Each member of the legislature, upon verification  of  attendance,
     5  which  shall  be by electronic verification when practicable, in compli-
     6  ance with the policies set forth by the speaker of the assembly and  the
     7  temporary  president of the senate for their respective bodies, shall be
     8  eligible to receive payment of actual and necessary travel expenses  and
     9  a  per  diem  equivalent  to  the  most  recent  federal  per diem rates
    10  published by the general services administration as set forth in 41  CFR
    11  (Code  of  Federal  Regulations) Part 301, App. A, for the time in which
    12  the member was in travel status in the performance of his or her  duties
    13  during the months in which the legislature is scheduled to be in regular
    14  session.  During  the months when the legislature is not scheduled to be
    15  in regular session, members shall  receive  such  actual  and  necessary
    16  travel  expenses and per diems, in compliance with verification policies
    17  and in accord with standards and  limits  for  reimbursable  events  set
    18  forth  by the speaker of the assembly and the temporary president of the
    19  senate for their respective bodies. The per  diem  allowances  including
    20  partial  per  diem  allowances shall be made on audit and warrant of the
    21  comptroller on vouchers approved  by  the  temporary  president  of  the
    22  senate  or his or her designee and speaker of the assembly or his or her
    23  designee  for  their  respective  houses.  Notwithstanding   any   other

     1  provision  of  this  section,  the per diem rate received by legislators
     2  with secondary incomes that exceed twenty percent of  their  legislative
     3  salaries,  shall  not  exceed  the per diem rate established for the two
     4  thousand nine-two thousand ten state fiscal year.
     5    § 2. This act shall take effect immediately.
