          printed to be committed to the Committee on Judiciary

        AN ACT to amend the general construction law and the administrative code
          of the city of New York, in relation to observing Atlantic time

          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:

     1    Section 1. The secretary of state shall develop and submit an applica-
     2  tion  to  the  federal  government requesting that the state observe the
     3  Atlantic Time Zone.
     4    § 2. Section 52 of the general construction law, as amended by chapter
     5  377 of the laws of 1955, is amended to read as follows:
     6    § 52. Time, standard. 1. The standard time throughout  this  state  is
     7  that  of  the  [seventy-fifth]  sixtieth meridian of longitude west from
     8  Greenwich, except as hereinafter provided, and  all  courts  and  public
     9  officers,  and legal and official proceedings, shall be regulated there-
    10  by.
    11    2. At two o'clock ante meridian on the [last] second Sunday in [April]
    12  March of each year the standard time  throughout  this  state  shall  be
    13  advanced  one hour from that of the [seventy-fifth] sixtieth meridian of
    14  longitude west from Greenwich, and the time so advanced  shall  continue
    15  to  be standard time throughout this state until the [last] first Sunday
    16  in [October] November of the same year, when such standard time,  as  so
    17  advanced,  shall  be  retarded  to  that of the [seventy-fifth] sixtieth
    18  meridian west from Greenwich; and during such period in  each  year  all
    19  courts and public officers, and legal and official proceedings, shall be
    20  regulated in accordance therewith.
    21    §  3. Section 2-106 of the administrative code of the city of New York
    22  is amended to read as follows:
    23    § 2-106 Daylight saving time; effect thereof  on  public  proceedings.
    24  The standard time throughout the city of New York is that of the [seven-
    25  ty-fifth]  sixtieth  meridian  of  longitude west from Greenwich, except

     1  that at two o'clock ante-meridian of the [last] second Sunday in [April]
     2  March of each year such standard  time  throughout  the  city  shall  be
     3  advanced  one hour, and at two o'clock ante-meridian of the [last] first
     4  Sunday  in [October] November of each year, such standard time shall, by
     5  the retarding of one hour, be returned to the mean astronomical time  of
     6  the  [seventy-fifth] sixtieth meridian of longitude west from Greenwich,
     7  and all courts, public offices and legal and official proceedings  shall
     8  be regulated thereby.
     9    §  4.  This act shall take effect immediately; provided, however, that
    10  section one of this act shall take effect upon the enactment into law by
    11  the states of Connecticut, New Jersey, and Pennsylvania  of  legislation
    12  having an identical effect with this act, but if the states of Connecti-
    13  cut, New Jersey, and Pennsylvania shall have already enacted such legis-
    14  lation,  section one of this act shall take effect immediately; provided
    15  further, however, that sections two and three of  this  act  shall  take
    16  effect at two o'clock ante meridian on the first Sunday of November next
    17  succeeding  the  approval  of an application by the state to the federal
    18  government requesting that the state observe  the  Atlantic  Time  Zone;
    19  provided  that  the secretary of state shall notify the legislative bill
    20  drafting commission upon the occurrence of the enactment of  the  legis-
    21  lation  provided  for in section one of this act and upon the occurrence
    22  of the approval of the application to the federal government  requesting
    23  that  the state observe the Atlantic Time Zone in order that the commis-
    24  sion may maintain an accurate and timely  effective  data  base  of  the
    25  official  text  of  the  laws of the state of New York in furtherance of
    26  effectuating the provisions of section 44 of  the  legislative  law  and
    27  section 70-b of the public officers law.
