          HELMING, LANZA, O'MARA, ORTT, RITCHIE, SERINO, TEDISCO --  read  twice

        AN  ACT  to  amend  the  penal law, in relation to the classification of
          certain crimes relating to assaults on police officers

          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:

     1    Section 1. The closing paragraph of section 120.05 of the penal law is
     2  amended to read as follows:
     3    Assault  in  the second degree is a class D felony; provided, however,
     4  assault in the second degree as defined in  subdivision  three  of  this
     5  section is a class C felony.
     6    §  2.  The  closing  paragraph  of section 120.08 of the penal law, as
     7  amended by chapter 476 of the laws  of  2018,  is  amended  to  read  as
     8  follows:
     9    Assault  on  a peace officer, police officer, firefighter or emergency
    10  medical services professional is a class [C] B felony.
    11    § 3. The closing paragraph of section 120.11  of  the  penal  law,  as
    12  amended  by  chapter  283  of  the  laws  of 1993, is amended to read as
    13  follows:
    14    Aggravated assault upon a police officer or a peace officer is a class
    15  [B] A felony.
    16    § 4. This act shall take effect immediately.
