        Introduced  by  Sen.  CLEARE -- read twice and ordered printed, and when
          printed to be committed to the Committee on Women's Issues

        AN ACT to amend the public health law, in relation  to  third  trimester
          syphilis testing

          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:

     1    Section 1. Subdivision 1 of section 2308 of the public health  law  is
     2  amended to read as follows:
     3    1. Every physician or other authorized practitioner attending pregnant
     4  [women] patients in the state shall in the case of every [woman] patient
     5  so  attended take or cause to be taken a sample of blood of such [woman]
     6  patient at the time of first examination, and submit such sample  to  an
     7  approved  laboratory  for  a  standard serological test for syphilis. In
     8  addition to testing at the time of first examination, every such  physi-
     9  cian  or  other authorized practitioner may order a syphilis test during
    10  the third trimester of pregnancy consistent with any guidance and  regu-
    11  lations issued by the commissioner.
    12    §  2. Subdivision 1 of section 207 of the public health law is amended
    13  by adding a new paragraph (r) to read as follows:
    14    (r) congenital syphilis, including  information  about  education  and
    15  screening.
    16    §  3. This act shall take effect one year after it shall have become a
    17  law. Effective immediately, any rules and regulations or guidance neces-
    18  sary to implement the provisions of this act on its effective  date  are
    19  authorized  to be amended, repealed and/or promulgated on or before such
    20  date.
