          printed to be committed to the Committee on Transportation

        AN  ACT  to  amend the vehicle and traffic law and the parks, recreation
          and historic preservation  law,  in  relation  to  vintage  snowmobile
          registrations

          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:

     1    Section 1. Subdivision 4-a of section 2222 of the vehicle and  traffic
     2  law,  as  amended by chapter 609 of the laws of 2005, is amended to read
     3  as follows:
     4    4-a. Additional fee. (a) In addition to the other fees provided for in
     5  paragraphs (a), (b) and (c) of subdivision  four  of  this  section  the
     6  commissioner  shall, upon application in such cases for the registration
     7  of a snowmobile or the renewal thereof, collect the annual ninety dollar
     8  fee for residents and ninety dollar fee for nonresidents and  a  thirty-
     9  five  dollar  fee  for residents and thirty-five dollar fee for nonresi-
    10  dents who provide proof, at the time of registration, that such individ-
    11  ual is a member of an organized New York state snowmobile club that is a
    12  member of the New York state snowmobile association or is a member of an
    13  organized New York state snowmobile club that  is  a  trail  maintenance
    14  entity  and  a member of the New York state snowmobile association which
    15  are imposed by section 21.07 of the parks, recreation and historic pres-
    16  ervation law. In the event that an individual  seeking  snowmobile  club
    17  membership is unable, for any reason, to secure such club membership, he
    18  or  she may contact the New York state snowmobile association, who shall
    19  secure such membership for such person. This fee shall also be collected
    20  from dealers at the time of original registration and  at  the  time  of
    21  each  renewal.  The  commissioner shall effectuate regulations regarding
    22  what is required as proof of membership in an organized New  York  state
    23  snowmobile  club  that is a trail maintenance entity and a member of the

     1  New York state snowmobile association for the purposes of this  subdivi-
     2  sion.
     3    (b)  Notwithstanding any provision of law to the contrary, the commis-
     4  sioner is hereby authorized and directed to develop and issue to  appli-
     5  cants a special vintage registration for a snowmobile manufactured prior
     6  to  January  first,  nineteen  hundred eighty. Such vintage registration
     7  shall be identifiable by a vintage registration sticker, have  a  unique
     8  registration number and be subject to annual renewal. In addition to the
     9  fees  collected  pursuant  to  paragraph (f) of subdivision four of this
    10  section, the commissioner shall collect an annual fee of ten dollars for
    11  a resident and non-resident applicant who provides proof, at the time of
    12  registration, that such individual is a member of an organized New  York
    13  state  snowmobile club that is a member of the New York state snowmobile
    14  association or is a member of an organized  New  York  state  snowmobile
    15  club  that  is  a  trail maintenance entity and a member of the New York
    16  state snowmobile association. The commissioner may provide that applica-
    17  tions for a vintage snowmobile registration and the issuing of a vintage
    18  snowmobile registration may only be accepted and  processed  at  one  or
    19  more facilities operated by the department either by mail or in person.
    20    §  2.  Subdivision 4 of section 2222 of the vehicle and traffic law is
    21  amended by adding a new paragraph (f) to read as follows:
    22    (f) A fee of five dollars for each individual resident  and  non-resi-
    23  dent vintage registration.
    24    §  3. Section 21.07 of the parks, recreation and historic preservation
    25  law is amended by adding a new subdivision 3 to read as follows:
    26    3. Notwithstanding the fee as established in subdivisions one and  two
    27  of  this  section,  an  individual resident or nonresident registering a
    28  vintage snowmobile who provides proof at the time of registration,  that
    29  such  individual  is  a member of an organized New York state snowmobile
    30  club that is a member of the New York state snowmobile association or is
    31  a member of an organized New York state snowmobile club that is a  trail
    32  maintenance entity and a member of the New York state snowmobile associ-
    33  ation, shall pay an additional fee of ten dollars for each vintage snow-
    34  mobile  for  the  snowmobile  trail  development and maintenance fund in
    35  addition to the registration required by the vehicle and traffic law. In
    36  the event that an  individual  seeking  snowmobile  club  membership  is
    37  unable,  for  any  reason, to secure such club membership, he or she may
    38  contact the New York state snowmobile association, who shall secure such
    39  membership for such person.
    40    § 4. This act shall take effect on the ninetieth day  after  it  shall
    41  have become a law. Effective immediately, the addition, amendment and/or
    42  repeal  of  any  rule  or regulation necessary for the implementation of
    43  this act on its effective date are authorized to be made  and  completed
    44  on or before such effective date.
