GAUGHRAN, BROOKS -- read twice and ordered printed, and when printed to be committed to the Committee on Energy and Tele- communications -- recommitted to the Committee on Energy and Telecom- munications in accordance with Senate Rule 6, sec. 8 -- committee discharged, bill amended, ordered reprinted as amended and recommitted to said committee AN ACT to amend the public authorities law, in relation to the applica- bility of the freedom of information law to the Long Island Power Authority and the disclosure of third party power purchase agreements The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. The public authorities law is amended by adding a new 2 section 1020-ll to read as follows: 3 § 1020-ll. Authority subject to freedom of information law. 1. The 4 authority shall be subject to the provisions of article six of the 5 public officers law relating to the freedom of information law. 6 2. Power purchase agreements with third parties shall be subject to 7 full disclosure. The authority shall make such contracts available for 8 public inspection and copying. The authority shall not determine that 9 such agreements are exempt from disclosure in full or in part, pursuant 10 to paragraph (d) of subdivision two of section eighty-seven of the 11 public officers law. 12 § 2.
