       Introduced  by  Sen.  KRUGER -- read twice and ordered printed, and when
         printed to be committed to the Committee on Social Services
       AN ACT to amend the social services law, in relation to eligibility  for
         additional  state  payments  to  recipients  of  supplemental security
         income benefits and  repealing  paragraph  (b)  of  subdivision  2  of
         section 209 of such law relating thereto
         THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section 1. Paragraph (b) of subdivision 2 of section 209 of the social
    2  services law is REPEALED.
    3    S 2. Subdivision 3 of section  209  of  the  social  services  law  is
    4  amended by adding two new paragraphs (f) and (g) to read as follows:
    5    (F)  "LIVING  WITH OTHERS" SHALL MEAN A COUPLE OR PERSON WHO IS LIVING
    6  IN A PRIVATE HOUSEHOLD WITH ANOTHER INDIVIDUAL OR  INDIVIDUALS  AND  WHO
    7  ARE:
    8    (I) RECEIVING MAINTENANCE AND SUPPORT (FOOD AND SHELTER) FROM ANOTHER;
    9    (II) A CHILD UNDER THE AGE OF EIGHTEEN; OR
   10    (III)  A CHILD UNDER THE AGE OF TWENTY-TWO WHO IS ATTENDING AN ACCRED-
   11  ITED SCHOOL.
   12    (G) ANY PERSON NOT LIVING WITH OTHERS AS DEFINED IN PARAGRAPH  (F)  OF
   13  THIS SUBDIVISION SHALL BE DEEMED TO BE LIVING ALONE.
   14    S  3. This act shall take effect on the first of April next succeeding
   15  the date on which it shall have become a law.
