       Introduced  by  Sen. ADDABBO -- read twice and ordered printed, and when
         printed to be committed to the Committee on Codes
       AN ACT to amend the penal law, in relation to  the  crime  of  vehicular
         manslaughter, and to repeal certain provisions of the penal law relat-
         ing thereto
         THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section 1. The section heading, opening paragraph  and  closing  para-
    2  graph  of  section 125.12 of the penal law, as amended by chapter 732 of
    3  the laws of 2006, are amended to read as follows:
    4    Vehicular manslaughter [in the second degree].
    5    A person is guilty of vehicular manslaughter [in  the  second  degree]
    6  when he or she causes the death of another person, and either:
    7    Vehicular manslaughter [in the second degree] is a class [D] A-I felo-
    8  ny.
    9    S 2. Section 125.13 of the penal law is REPEALED.
   10    S  3.  This  act shall take effect on the ninetieth day after it shall
   11  have become a law.
