        Introduced  by  Sen.  CROCI  -- read twice and ordered printed, and when
          printed to be committed to the Committee on Finance
        AN ACT to amend the executive law  and  the  not-for-profit  corporation
          law,  in relation to a public listing of certain not-for-profit corpo-
          rations
          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:
     1    Section 1. Section 190 of the executive law is amended by adding a new
     2  subdivision 5 to read as follows:
     3    5.  The adjutant general, in conjunction with the department of state,
     4  shall establish and maintain on the division's website a public  listing
     5  of  all  approved  not-for-profit  corporations  soliciting funds for or
     6  otherwise benefiting the armed forces of the United  States  or  of  any
     7  foreign  country, or their auxiliaries, or of this or any other state or
     8  territory.
     9    § 2. Paragraph (i) of section 404 of  the  not-for-profit  corporation
    10  law,  as  amended by chapter 134 of the laws of 2016, is amended to read
    11  as follows:
    12    (i) Every  certificate  of  incorporation  which  indicates  that  the
    13  proposed  corporation  is  to solicit funds for or otherwise benefit the
    14  armed forces of the United States or of any foreign  country,  or  their
    15  auxiliaries,  or of this or any other state or any territory, shall have
    16  endorsed thereon or annexed thereto the approval of the adjutant  gener-
    17  al.  The  department of state, in conjunction with the division of mili-
    18  tary and naval affairs, shall establish and maintain on the department's
    19  website a public listing of  all  approved  not-for-profit  corporations
    20  soliciting  funds  for  or  otherwise benefiting the armed forces of the
    21  United States or of any foreign country, or  their  auxiliaries,  or  of
    22  this or any other state or territory.
    23    § 3. This act shall take effect on the one hundred twentieth day after
    24  it shall have become a law.
