       Introduced  by  Sen.  LIBOUS -- read twice and ordered printed, and when
         printed to be committed to the Committee on Civil Service and Pensions
       AN ACT to grant William J. Horrigan eligibility for accidental disabili-
         ty retirement benefits
         THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section  1.  Notwithstanding  any  provision  of  law to the contrary,
    2  William J. Horrigan, a retiree receiving pension benefits from  the  New
    3  York state and local employees' retirement system since May 3, 2002, who
    4  prior  to  his  retirement,  through no negligence of his own, broke his
    5  neck and became physically incapacitated for performance of duty  during
    6  2002  while actually in service in his public employment by the Bingham-
    7  ton-Johnson City joint sewage board, a participating employer, shall  be
    8  deemed entitled to an accidental disability retirement allowance, pursu-
    9  ant  to  section  63  of  the retirement and social security law, on and
   10  after May 3, 2002, if within 1 year of the effective date of  this  act,
   11  he files an application therefor with the state comptroller.
   12    S 2. All costs associated with the implementation of the provisions of
   13  this  act  shall  be  borne  by the Binghamton-Johnson City joint sewage
   14  board.
   15    S 3. This act shall take effect immediately.
