AN ACT to amend the general municipal law, in relation to allowing the
governing body of Westchester county to appoint a member of the West-
chester county industrial development agency
THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:
1 Section 1. Section 923-a of the general municipal law, as amended by
2 chapter 564 of the laws of 1983, is amended to read as follows:
3 S 923-a. County of Westchester industrial development agency. For the
4 benefit of the county of Westchester and the inhabitants thereof, an
5 industrial development agency, to be known as the COUNTY OF WESTCHESTER
6 INDUSTRIAL DEVELOPMENT AGENCY, is hereby established for the accomplish-
7 ment of any or all of the purposes specified in title one of article
8 eighteen-A of this chapter. It shall constitute a body corporate and
9 politic, and be perpetual in duration. It shall have the powers and
10 duties now or hereafter conferred by title one of article eighteen-A of
11 this chapter upon industrial development agencies and provided that the
12 exercise of the powers by such agency with respect to the acquisition of
13 real property whether by purchase, condemnation or otherwise, shall be
14 limited to the corporate limits of the county of Westchester and such
15 agency shall take into consideration the local zoning and planning regu-
16 lations as well as regional and local land use plans. The agency shall
17 not use its funds to commence any project unless (i) at least thirty
18 days' prior notice of such project shall have been given to each local
19 municipality in which a part or parts of the project is, or is to be,
20 located and (ii) no objection, by resolution of the governing body of
21 such municipality, shall have been made and delivered to the agency
22 within such thirty days. Notwithstanding the provisions of the next
23 preceding sentence, in the case of a project which is, or is to be,
24 located within a village within the county of Westchester, notice to

1 such village shall be sufficient as to any part or parts of the project
2 within the village and no other notice shall be required to be given to
3 any other municipality in which such village is located with respect
4 thereto. It shall be organized in a manner prescribed by and be subject
5 to the provisions of title one of article eighteen-A of this chapter and
6 shall consist of [seven] EIGHT members. Its members shall be appointed
7 by the chief executive officer of the county of Westchester, subject to
8 confirmation by its governing body, EXCEPT THAT ONE MEMBER SHALL BE
9 APPOINTED BY THE PRESIDING OFFICER OF THE GOVERNING BODY OF THE COUNTY
10 OF WESTCHESTER, SUBJECT TO CONFIRMATION BY ITS GOVERNING BODY, WHO MAY
11 BE A MEMBER OF SUCH GOVERNING BODY. THE MEMBER APPOINTED BY THE PRESID-
12 ING OFFICER SHALL BE A NON-VOTING MEMBER. The agency, its members, offi-
13 cers and employees, and its operations and activities shall in all
14 respects be governed by the provisions of title one of article eigh-
15 teen-A of this chapter.
16 S 2. This act shall take effect immediately.
