STATE OF NEW YORK ________________________________________________________________________ 1419 2017-2018 Regular Sessions IN SENATE January 9, 2017 ___________ Introduced by Sen. AVELLA -- read twice and ordered printed, and when printed to be committed to the Committee on Environmental Conservation AN ACT in relation to requiring the department of environmental conser- vation to review the policies of the department of parks and recre- ation of the city of New York regarding trees and tree maintenance The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Notwithstanding any other rule, regulation or policy to the 2 contrary, the department of environmental conservation shall review and 3 provide oversight to the department of parks and recreation of the city 4 of New York in relation to city-owned trees, tree maintenance, care and 5 cultivation of such trees, liability in case of personal or property 6 injury by such trees, and any other matters the department of environ- 7 mental conservation deems necessary. 8 § 2.
