STATE OF NEW YORK ________________________________________________________________________ 1310 2021-2022 Regular Sessions IN SENATE January 11, 2021 ___________ Introduced by Sen. BRESLIN -- read twice and ordered printed, and when printed to be committed to the Committee on Rules AN ACT to amend the election law, in relation to requiring the county seat in Washington county to have at least one polling place desig- nated for early voting The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Paragraph (a) of subdivision 2 of section 8-600 of the 2 election law, as added by a chapter of the laws of 2020, amending the 3 election law, relating to requiring municipalities with the highest 4 population in each county to have at least one polling place designated 5 for early voting, as proposed in legislative bills numbers S.8782 and A. 6 8610-B, is amended to read as follows: 7 (a) The board of elections shall designate polling places for early 8 voting, which may include the offices of the board of elections, for 9 persons to vote early pursuant to this title; provided, however, that 10 the municipality with the highest population in each county based on the 11 latest federal decennial census, or the county seat in Washington coun- 12 ty, shall have at least one polling place designated for early voting, 13 and to the extent practicable if such municipality has public transpor- 14 tation routes, such polling place shall be situated along such transpor- 15 tation routes. There shall be so designated at least one early voting 16 polling place for every full increment of fifty thousand registered 17 voters in each county; provided, however, the number of early voting 18 polling places in a county shall not be required to be greater than ten 19 unless required by any other provision of law, and a county with fewer 20 than fifty thousand voters shall have at least one early voting polling 21 place. 22 § 2. This act shall take effect on the same date and in the same 23 manner as a chapter of the laws of 2020 amending the election law, 24 relating to requiring municipalities with the highest population in each 25 county to have at least one polling place designated for early voting, 26 as proposed in legislative bills numbers S.8782 and A. 8610-B, takes 27 effect.
