STATE OF NEW YORK ________________________________________________________________________ 1297 2019-2020 Regular Sessions IN SENATE January 14, 2019 ___________ Introduced by Sens. SERINO, CARLUCCI, JACOBS, LAVALLE, LITTLE, RITCHIE, SEWARD, TEDISCO -- read twice and ordered printed, and when printed to be committed to the Committee on Education AN ACT to amend the education law, in relation to rules and regulations concerning removal of ticks from pupils The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Section 305 of the education law is amended by adding a new 2 subdivision 60 to read as follows: 3 60. The commissioner, in conjunction with the commissioner of health, 4 shall promulgate and review as necessary rules and regulations related 5 to pupils who have a tick removed from them while receiving instruction 6 or engaging in any school sponsored or related activity. Such regu- 7 lations shall include but not be limited to: 8 (a) Tick removal guidelines for school nurses, school physicians, 9 teachers or employees of a school district to be developed by the 10 commissioner of health. 11 (b) Procedures for written notification to a parent or guardian after 12 a tick has been removed from a pupil. Written notification shall 13 include, but not be limited to, the inclusion of informational materials 14 developed by the commissioner of health about the spread of Lyme 15 disease and tick-borne disease, signs and symptoms of Lyme or tick-borne 16 diseases, and recommendations for how and when to seek medical treatment 17 if needed. 18 (c) The development of informational materials for school districts 19 and parents to be provided on the websites of the department and the 20 department of health. 21 The rules and regulations established pursuant to this subdivision 22 shall be deemed to be the minimum standards that must be complied with 23 by every public school relating to the removal of ticks on pupils. This act shall take effect on the one hundred twentieth day after 4 it shall have become a law.
