       Introduced  by  Sen.  ALESI  -- read twice and ordered printed, and when
         printed to be committed to the Committee on Transportation
       AN ACT to amend the vehicle and traffic law, in relation to exempting  a
         motor  vehicle  with  an  automatic or remote car starter from certain
         prohibitions
         THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section  1. Subdivision (a) of section 1210 of the vehicle and traffic
    2  law, as amended by chapter 350 of the laws of 1967, is amended  to  read
    3  as follows:
    4    (a)  No person driving or in charge of a motor vehicle shall permit it
    5  to stand unattended without  first  stopping  the  engine,  locking  the
    6  ignition, removing the key from the vehicle, and effectively setting the
    7  brake  thereon  and,  when  standing  upon  any grade, turning the front
    8  wheels to the curb or  side  of  the  highway,  provided,  however,  the
    9  provision  for  removing  the key from the vehicle shall not require the
   10  removal of keys hidden from sight about the vehicle for  convenience  or
   11  emergency;  PROVIDED,  FURTHER,  THAT THE PROVISIONS OF THIS SUBDIVISION
   12  SHALL NOT APPLY TO ANY MOTOR VEHICLE WITH AN  AUTOMATIC  OR  REMOTE  CAR
   13  STARTER WHERE SUCH MOTOR VEHICLE IS ABLE TO REMAIN RUNNING WITH OR WITH-
   14  OUT  KEYS IN THE IGNITION AND ALL OF THE DOORS TO SUCH MOTOR VEHICLE ARE
   15  LOCKED.
   16    S 2.  This act shall take effect on  the  one  hundred  eightieth  day
   17  after  it  shall  have  become  a law; provided, however, that effective
   18  immediately, the addition, amendment and/or repeal of any rule or  regu-
   19  lation  necessary  for  the  implementation of this act on its effective
   20  date are authorized and directed to be made and completed on  or  before
   21  such effective date.
