       Introduced  by  Sen. VALESKY -- read twice and ordered printed, and when
         printed to be committed to the Committee on Higher Education
       AN ACT to amend the education law, in relation to granting SUNY communi-
         ty college campus peace officers access  to  criminal  history  record
         information pursuant to 9 NYCRR 6051.1
         THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section 1. Section 6434 of the education law is amended  by  adding  a
    2  new subdivision 1-a to read as follows:
    3    1-A.  FOR  THE  PURPOSE  OF FACILITATING INVESTIGATIONS SUNY COMMUNITY
    4  COLLEGE CAMPUS PEACE OFFICERS SHALL BE DEEMED AUTHORIZED USERS, ABLE  TO
    5  ACCESS  CRIMINAL  HISTORY RECORD INFORMATION, PURSUANT TO 9 NYCRR 6051.1
    6  SUBJECT TO THE FOLLOWING DUTIES:
    7    A. EACH COMMUNITY COLLEGE SHALL BE REQUIRED TO DOCUMENT EACH OFFICER'S
    8  ACTIVITY WITH REGARD TO ACCESSING SUCH  INFORMATION  AND  THE  OFFICER'S
    9  REASONABLE CAUSE FOR NEEDING SUCH ACCESS.
   10    B. THE COMMUNITY COLLEGE SHALL ESTABLISH AN INTERNAL REVIEW PROCESS TO
   11  ENSURE EVERY INQUIRY IS JUSTIFIED AND IS SUPPORTED BY SUFFICIENT REASON-
   12  ABLE CAUSE.
   13    S 2. This act shall take effect immediately.
