       AN ACT to amend the judiciary law, in relation to  creating  a  separate
         office of surrogate in the county of Niagara
         THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section 1. Section 185 of the judiciary law, as added by  chapter  699
    2  of the laws of 1969, is amended to read as follows:
    3    S  185.  Separate  office  of surrogate in the counties of Chautauqua,
    4  Nassau, NIAGARA and Rockland. There is established a separate office  of
    5  surrogate  in  the counties of Chautauqua, Nassau, NIAGARA and Rockland.
    6  The election and term of such surrogate shall be in the manner  provided
    7  by  section  twelve  of article six of the constitution. He OR SHE shall
    8  have all the powers now established by law.
    9    S 2. This act shall take effect August  1,  2009;  provided,  however,
   10  that  the additional surrogate's court judgeship provided for by section
   11  one of this act shall first be elected at the  general  election  to  be
   12  held in November 2009 and shall first take office January 1, 2010.
