STATE OF NEW YORK ________________________________________________________________________ 281 2023-2024 Regular Sessions IN SENATE (Prefiled) January 4, 2023 ___________ Introduced by Sen. GOUNARDES -- read twice and ordered printed, and when printed to be committed to the Committee on Codes AN ACT to amend the criminal procedure law, in relation to periods of limitation in calculating the timeliness of prosecution The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Subdivision 4 of section 30.10 of the criminal procedure 2 law is amended by adding a new paragraph (c) to read as follows: 3 (c) Any period of time following the commission of the offense during 4 which an individual was unjustly convicted and imprisoned as established 5 pursuant to section eight-b of the court of claims act. 6 § 2. This act shall take effect immediately and shall apply to prose- 7 cutions for which the period of limitation has not expired pursuant to 8 section 30.10 of the criminal procedure law.
