Bill Title: Provides that parent or guardian shall give notice to school district wherein child resides of intent to send child to charter school; such notice shall be sent prior to April first in the year that the child is to attend the charter school in September, or within thirty days of establishing residence in the school district.

       Introduced by Sen. FUSCHILLO -- read twice and ordered printed, and when
         printed to be committed to the Committee on Education
       AN  ACT  to  amend  the  education  law, in relation to notice to school
         districts regarding intent to attend a charter school
         THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section  1.  Subdivision  2  of  section  2854 of the education law is
    2  amended by adding a new paragraph (e) to read as follows:
    3    (E) A PARENT OR GUARDIAN OF A CHILD RESIDING IN ANY  SCHOOL  DISTRICT,
    4  OR ANY REPRESENTATIVE AUTHORIZED BY SUCH PARENT OR GUARDIAN, WHO DESIRES
    5  FOR  A  CHILD  TO  ATTEND A CHARTER SCHOOL SHALL SUBMIT A WRITTEN NOTICE
    6  THEREOF TO THE SCHOOL TRUSTEES OR BOARD OF EDUCATION  OF  SUCH  DISTRICT
    7  NOT  LATER  THAN  THE FIRST DAY OF APRIL PRECEDING THE NEXT SCHOOL YEAR,
    8  AND IN THE CASE WHERE SUCH PUPIL  ATTENDS  A  NONPUBLIC  SCHOOL,  NOTICE
    9  SHALL ALSO BE PROVIDED TO SUCH NONPUBLIC SCHOOL, PROVIDED, HOWEVER, THAT
   10  A  PARENT  OR  GUARDIAN  OF A CHILD NOT RESIDING IN THE DISTRICT ON SUCH
   11  DATE SHALL SUBMIT A WRITTEN NOTICE WITHIN THIRTY DAYS AFTER ESTABLISHING
   12  RESIDENCE IN THE DISTRICT.
   13    S 2. This act shall take effect immediately.
