       AN  ACT to establish a task force to examine, assess and report upon the
         potential effects of an offshore oil spill on Long Island
         THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section 1. A task force is hereby established to examine, evaluate and
    2  make recommendations concerning the potential effects of an offshore oil
    3  spill  on  the  counties  of Nassau and Suffolk. Such task force, to the
    4  maximum extent  practicable,  shall  coordinate  with  and  utilize  the
    5  resources  of  the  Coast Guard and the National Oceanic and Atmospheric
    6  Administration. The task force shall direct its attention to the  poten-
    7  tial  effects  of  an  offshore  oil spill on the counties of Nassau and
    8  Suffolk relating to:
    9    (a) Evaluating the probability of an offshore oil spill occurring that
   10  will affect the counties of Nassau and Suffolk;
   11    (b) Evaluating the consequences of an  offshore  oil  spill  on  busi-
   12  nesses,  residents,  wildlife,  fishing  and  tourism in the counties of
   13  Nassau and Suffolk;
   14    (c) Evaluating the commercial, legal and environmental impacts  caused
   15  by an offshore oil spill on the counties of Nassau and Suffolk; and
   16    (d)  Examining methodologies which may prevent offshore oil spills and
   17  those that would mitigate the effects of such an oil spill on the  coun-
   18  ties of Nassau and Suffolk.
   19    S  2. (a) The task force shall consist of 9 members to be appointed as
   20  follows:
   21    (i) one member appointed by the commissioner of environmental  conser-
   22  vation;
   23    (ii) one member appointed by the attorney general;
   24    (iii)  one  member  appointed  by  the director of the state emergency
   25  management office;
   26    (iv) one member appointed by the commissioner of parks, recreation and
   27  historic preservation;

    1    (v) one member appointed by the state comptroller;
    2    (vi) one member appointed by the governor;
    3    (vii) one member appointed by the commissioner of transportation;
    4    (viii) one member appointed by majority vote of the county legislature
    5  of the county of Nassau; and
    6    (ix)  one  member appointed by majority vote of the county legislature
    7  of the county of Suffolk.
    8    (b) The chair of the task force shall be elected  by  the  task  force
    9  from  amongst  its  membership.  Vacancies in the membership of the task
   10  force shall be filled in the manner provided for original appointments.
   11    S 3. The task force shall meet within the  state,  shall  hold  public
   12  hearings and shall have all the powers of a legislative committee pursu-
   13  ant to the legislative law.
   14    S  4.  The members of the task force shall receive no compensation for
   15  their services, but shall be allowed their actual and necessary expenses
   16  incurred in the performance of their duties pursuant to this act.
   17    S 5. To the maximum extent feasible, the task force shall be  entitled
   18  to  request  and  receive,  and  shall utilize and be provided with such
   19  facilities, resources and  data  of  any  department,  division,  board,
   20  bureau,  commission  or agency of the state or any political subdivision
   21  thereof as it may reasonably request to properly carry out its duties.
   22    S 6. The task force shall submit a written report, to the governor and
   23  the legislature, of its findings, conclusions and recommendations within
   24  120 days of the effective date of this act.  The  written  report  shall
   25  include  such  legislative  proposals as it deems necessary to implement
   26  its recommendations.
   27    S 7. This act shall take effect immediately.
