         tee on Consumer Affairs and Protection
       AN ACT to amend the general business law, in relation to motor  vehicles
         equipped with factory installed global positioning systems
         THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section 1. Section 198-b of the general business  law  is  amended  by
    2  adding a new subdivision h to read as follows:
    3    H.  MOTOR  VEHICLES EQUIPPED WITH FACTORY INSTALLED GLOBAL POSITIONING
    4  SYSTEMS.
    5    1. IT SHALL BE THE DUTY OF ANY  DEALER  OF  USED  MOTOR  VEHICLES,  AS
    6  DEFINED IN SUBDIVISION A OF THIS SECTION, TO ASSURE THAT ANY MOTOR VEHI-
    7  CLE  SOLD  BY SUCH DEALER AND FITTED WITH FACTORY INSTALLED GLOBAL POSI-
    8  TIONING EQUIPMENT HAVE ANY ADDRESSES AND OTHER DATA  CLEARED  FROM  SUCH
    9  GLOBAL  POSITIONING EQUIPMENT PRIOR TO DELIVERY OF SUCH MOTOR VEHICLE TO
   10  A NEW OWNER.
   11    2. FAILURE TO COMPLY WITH THIS SUBDIVISION SHALL BE  PUNISHABLE  BY  A
   12  CIVIL PENALTY NOT TO EXCEED ONE HUNDRED DOLLARS.
   13    S 2. This all shall take effect immediately.
