       AN ACT to amend the general municipal law and education law, in relation
         to providing that a transfer  of  functions  between  or  among  local
         governments  and  school  districts shall be taken into account in the
         tax levy limits thereof
         THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section 1. Paragraph (d) of subdivision 3 of section 3-c of the gener-
    2  al  municipal  law, as added by section 1 of part A of chapter 97 of the
    3  laws of 2011, is amended to read as follows:
    4    (d) Whenever the responsibility and associated cost of a local govern-
    5  ment OR SCHOOL function is transferred to another  local  government  OR
    6  SCHOOL  DISTRICT,  the  state  comptroller shall determine the costs and
    7  savings on the affected local governments OR SCHOOL DISTRICTS  attribut-
    8  able  to such transfer for the first fiscal year following the transfer,
    9  and notify such local governments OR SCHOOL DISTRICTS of  such  determi-
   10  nation and that they shall adjust their tax levy limits accordingly.
   11    S  2.  Section  2023-a of the education law is amended by adding a new
   12  subdivision 4-a to read as follows:
   13    4-A. WHENEVER THE  RESPONSIBILITY  AND  ASSOCIATED  COST  OF  A  LOCAL
   14  GOVERNMENT OR SCHOOL FUNCTION IS TRANSFERRED TO ANOTHER LOCAL GOVERNMENT
   15  OR  SCHOOL DISTRICT, THE STATE COMPTROLLER SHALL DETERMINE THE COSTS AND
   16  SAVINGS ON THE AFFECTED LOCAL GOVERNMENTS OR SCHOOL DISTRICTS  ATTRIBUT-
   17  ABLE  TO SUCH TRANSFER FOR THE FIRST FISCAL YEAR FOLLOWING THE TRANSFER,
   18  AND NOTIFY SUCH LOCAL GOVERNMENTS OR SCHOOL DISTRICTS OF  SUCH  DETERMI-
   19  NATION AND THAT THEY SHALL ADJUST THEIR TAX LEVY LIMITS ACCORDINGLY.
   20    S 3. This act shall take effect immediately and shall apply to budgets
   21  that  take  effect  on  or  after ninety days after such effective date;
   22  provided, further, that the amendments to paragraph (d) of subdivision 3
   23  of section 3-c of the general municipal law made by section one of  this
   24  act  shall  not affect the repeal of such section and shall be deemed to

    1  repeal therewith; and provided further, however, that the amendments  to
    2  section  2023-a  of  the  education  law made by section two of this act
    3  shall not affect the repeal of such  section  and  shall  be  deemed  to
    4  repeal therewith.
