       AN ACT to amend the public authorities law, in relation to the  composi-
         tion of the Niagara Frontier transportation authority
         THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section 1. Paragraph (c) of subdivision 1 of  section  1299-c  of  the
    2  public authorities law, as added by a chapter of the laws of 2012 amend-
    3  ing  the  public  authorities  law  relating  to  the composition of the
    4  Niagara Frontier transportation authority, as  proposed  in  legislative
    5  bills numbers S. 6536 and A. 9455, is amended to read as follows:
    6    (c)  There  shall also be a second non-voting member of the authority,
    7  who shall not be considered in determining a quorum. The second non-vot-
    8  ing member shall be appointed by the governor as a representative of the
    9  transit dependent COMMUNITY  and/or  [disabled  community]  PEOPLE  WITH
   10  DISABILITIES. The second non-voting member shall be appointed for a term
   11  of  five  years.  [The chair of the authority, at his or her discretion,
   12  may exclude such non-voting member from attending any portion of a meet-
   13  ing of the authority or of any committee held pursuant to the  executive
   14  session provisions of the open meetings law.]
   15    S  2.  This  act  shall  take  effect on the same date and in the same
   16  manner as a chapter of the laws of  2012,  as  proposed  in  legislative
   17  bills numbers S. 6536 and A. 9455, takes effect.
