        AN ACT establishing the "COVID-19 livery recovery act"

          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:

     1    Section  1.  Short  title. This act shall be known and may be cited as
     2  the "COVID-19 livery recovery act".
     3    § 2. Notwithstanding any local law to the contrary, the local taxi and
     4  limousine commission of any city with a population  of  one  million  or
     5  more which is enforcing a cap on for-hire vehicle licenses shall issue a
     6  limited number of for-hire vehicle licenses regardless of such cap. Such
     7  for-hire  vehicle  licenses  shall  be  referred  to as "livery recovery
     8  licenses" and shall be issued for the exclusive purpose  of  affiliating
     9  additional independent livery drivers with local livery bases.
    10    § 3. The total number of such livery recovery licenses to be issued by
    11  the local taxi and limousine commission shall be equal to the difference
    12  between  the  number  of  for-hire vehicle licenses that were affiliated
    13  with all local livery bases, on a per-livery-base basis, as of  February
    14  28, 2020, and the number of for-hire vehicle licenses that remain affil-
    15  iated  with  all  such  livery  bases, on a per-livery-base basis, as of
    16  April 30, 2022.
    17    § 4. An applicant who receives such a  livery  recovery  license  must
    18  affiliate  with a livery base which saw a reduction in the number of its
    19  affiliated drivers after February 28, 2020,  and  which  has  not  fully
    20  recouped the number of its affiliated drivers to such amount.
    21    §  5.  All  livery  recovery licensees shall be limited to affiliating
    22  only with a local livery base until the elimination of the local cap  on
    23  for-hire vehicle licenses, at which time such limitation expires and the
    24  livery  recovery  license  shall  be considered to be a for-hire vehicle
    25  license for all purposes under local law or regulation.
    26    § 6. For purposes of this act, "for-hire vehicle driver", "independent
    27  livery drivers", "license", "licensee", "livery base" and "livery" shall
    28  mean the same as defined by local law or regulation.
    29    § 7. This act shall take effect on the sixtieth  day  after  it  shall
    30  have become a law.
