        Introduced  by  COMMITTEE  ON  RULES -- (at request of M. of A. Peoples-
          Stokes) -- read once and referred to the Committee on Insurance

        AN ACT to amend the insurance  law  and  the  social  services  law,  in
          relation  to mandatory health insurance coverage for follow-up screen-
          ing or diagnostic services for lung cancer

          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:

     1    Section  1.  Subsection  (i)  of  section 3216 of the insurance law is
     2  amended by adding a new paragraph 39 to read as follows:
     3    (39) (A) Every policy which provides medical, major medical, or  simi-
     4  lar  comprehensive-type  coverage  shall  provide coverage for follow-up
     5  screening or diagnostic services for lung cancer when recommended  by  a
     6  health  care  provider  acting  within  the provider's scope of practice
     7  pursuant to title eight of the education law.
     8    (B) Notwithstanding any  other  provision  of  law,  any  policy  that
     9  provides  coverage  required  by this paragraph shall not impose patient
    10  cost sharing for follow-up screening or  diagnostic  services  for  lung
    11  cancer.
    12    § 2. Subsection (l) of section 3221 of the insurance law is amended by
    13  adding a new paragraph 22 to read as follows:
    14    (22)  (A) Every policy which provides medical, major medical, or simi-
    15  lar comprehensive-type coverage shall  provide  coverage  for  follow-up
    16  screening  or  diagnostic services for lung cancer when recommended by a
    17  health care provider acting within  the  provider's  scope  of  practice
    18  pursuant to title eight of the education law.
    19    (B)  Notwithstanding  any  other  provision  of  law,  any policy that
    20  provides coverage required by this paragraph shall  not  impose  patient
    21  cost  sharing  for  follow-up  screening or diagnostic services for lung
    22  cancer.
    23    § 3. Section 4303 of the insurance law is  amended  by  adding  a  new
    24  subsection (vv) to read as follows:
    25    (vv)  (1) Every policy which provides medical, major medical, or simi-
    26  lar comprehensive-type coverage shall  provide  coverage  for  follow-up
    27  screening  or  diagnostic services for lung cancer when recommended by a

     1  health care provider acting within  the  provider's  scope  of  practice
     2  pursuant to title eight of the education law.
     3    (2)  Notwithstanding  any  other  provision  of  law,  any policy that
     4  provides coverage required by this subsection shall not  impose  patient
     5  cost  sharing  for  follow-up  screening or diagnostic services for lung
     6  cancer.
     7    § 4. Subdivision 2 of section 365-a of  the  social  services  law  is
     8  amended by adding a new paragraph (nn) to read as follows:
     9     (nn)  (i)  follow-up screening or diagnostic services for lung cancer
    10  when recommended by a health care provider acting within the  provider's
    11  scope of practice pursuant to title eight of the education law.
    12    (ii)  notwithstanding any other provision of law, coverage required by
    13  this paragraph shall not  impose  patient  cost  sharing  for  follow-up
    14  screening or diagnostic services for lung cancer.
    15    § 5. This act shall take effect January 1, 2026 and shall apply to all
    16  policies  and contracts issued, renewed, modified, altered or amended on
    17  or after such date.
