CASTELLI -- read once and referred to the Commit- tee on Veterans' Affairs AN ACT to amend the military law and the state finance law, in relation to creating the veterans recruiter assistants program and providing for the repeal of such provisions upon expiration thereof THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: 1 Section 1. Legislative findings and intent. The legislature recognizes 2 that maintaining the strength of the New York army and air national 3 guard is critical to the homeland security of New York State. Veterans 4 of the active and reserve armed forces of the United States and of the 5 New York national guard are especially well qualified to assist in the 6 first-time recruitment of men and women for the New York national guard. 7 The legislature recognizes the need to promote a veterans incentive to 8 encourage qualified men and women to enlist in the New York national 9 guard by creating the veterans recruiter assistants program for the New 10 York national guard. 11 S 2. The military law is amended by adding a new section 262-a to read 12 as follows: 13 S 262-A. VETERANS RECRUITER ASSISTANTS PROGRAM FOR THE NEW YORK 14 NATIONAL GUARD. 1. THE DIVISION OF MILITARY AND NAVAL AFFAIRS IS AUTHOR- 15 IZED, WITHIN AMOUNTS APPROPRIATED OR OTHERWISE LAWFULLY AVAILABLE FROM 16 ANY SOURCE, TO ESTABLISH A VETERANS RECRUITER ASSISTANTS PROGRAM FOR THE 17 NEW YORK NATIONAL GUARD. 18 2. THE TERM "NEW YORK NATIONAL GUARD" SHALL MEAN THE NEW YORK ARMY 19 NATIONAL GUARD AND THE NEW YORK AIR NATIONAL GUARD. 20 3. A RECRUITING INCENTIVE AWARD NOT TO EXCEED FIVE HUNDRED DOLLARS 21 SHALL BE PAID BY THE DIVISION OF MILITARY AND NAVAL AFFAIRS TO ANY 22 VETERAN WHO HAS BEEN DISCHARGED FROM THE ARMED FORCES OF THE UNITED 23 STATES UNDER CONDITIONS OTHER THAN DISHONORABLE AND WHO FACILITATES THE 24 FIRST-TIME ENLISTMENT OF A QUALIFIED CANDIDATE INTO THE NEW YORK 25 NATIONAL GUARD. ONE-HALF OF THE RECRUITING INCENTIVE AWARD WILL BE PAID 26 TO THE RECRUITING VETERAN AT THE TIME OF THE FIRST-TIME ENLISTMENT OF 27 THE RECRUITED CANDIDATE INTO THE NEW YORK NATIONAL GUARD. LBD11246-01-9 A. 10342 2 1 ONE-HALF OF THE AWARD WILL BE PAID TO THE RECRUITING VETERAN AT THE TIME 2 THE ENLISTED RECRUIT BEGINS INITIAL ENTRY TRAINING, ALSO KNOWN AS BASIC 3 MILITARY TRAINING. 4 4. UNLESS OTHERWISE PROVIDED FOR IN THIS SECTION, ELIGIBILITY FOR THE 5 VETERANS RECRUITING INCENTIVE PROVIDED BY THIS SECTION SHALL BE DETER- 6 MINED BY THE ADJUTANT GENERAL OF NEW YORK STATE WHO SHALL PROMULGATE 7 SUCH ADMINISTRATIVE RULES AND PROCEDURES AS ARE NECESSARY TO IMPLEMENT 8 THE RECRUITING INCENTIVE PROVIDED UNDER THIS SECTION. 9 S 3. The state finance law is amended by adding a new section 91-h to 10 read as follows: 11 S 91-H. VETERANS RECRUITER ASSISTANTS PROGRAM ACCOUNT. 1. THERE IS 12 HEREBY ESTABLISHED IN THE JOINT CUSTODY OF THE STATE COMPTROLLER AND THE 13 COMMISSIONER OF TAXATION AND FINANCE AN ACCOUNT IN THE MISCELLANEOUS 14 SPECIAL REVENUE FUND TO BE KNOWN AS THE VETERANS RECRUITER ASSISTANTS 15 PROGRAM ACCOUNT. 16 2. SUCH ACCOUNT SHALL CONSIST OF ALL REVENUES RECEIVED FROM CONTRIB- 17 UTIONS, DONATIONS AND ALL OTHER MONEYS CREDITED OR TRANSFERRED THERETO 18 FROM ANY OTHER FUND OR SOURCE PURSUANT TO LAW. 19 3. MONEYS OF THE ACCOUNT, FOLLOWING APPROPRIATION BY THE LEGISLATURE, 20 MAY BE EXPENDED FOR THE VETERANS RECRUITER ASSISTANTS PROGRAM FOR THE 21 NEW YORK NATIONAL GUARD ESTABLISHED PURSUANT TO SECTION TWO HUNDRED 22 SIXTY-TWO-A OF THE MILITARY LAW. MONEYS SHALL BE PAID OUT OF THE ACCOUNT 23 ON THE AUDIT AND WARRANT OF THE STATE COMPTROLLER ON VOUCHERS CERTIFIED 24 OR APPROVED BY THE ADJUTANT GENERAL OF NEW YORK STATE. 25 S 4. The division of military and naval affairs shall report on the 26 operation and subsequent effectiveness of the program created by this 27 act, one year after it shall have become law and annually thereafter to 28 the governor, temporary president of the senate and the speaker of the 29 assembly. 30 S 5. This act shall take effect immediately and shall expire and be 31 deemed repealed five years after the date on which it shall have become 32 a law.
