       AN ACT to amend chapter 226 of the laws of 2003 relating to establishing
         the Brookville library funding district in the  town  of  Oyster  Bay,
         county  of  Nassau,  state  of  New York, in relation to extending the
         period of time during which  such  library  funding  district  may  be
         established
         THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section 1. Subdivision 2 of section 4 of chapter 226 of  the  laws  of
    2  2003 relating to establishing the Brookville library funding district in
    3  the  town of Oyster Bay, county of Nassau, state of New York, as amended
    4  by chapter 446 of the laws of 2008, is amended to read as follows:
    5    2. Upon receipt by the clerk of the town of Oyster Bay of  a  petition
    6  signed  by  not  less  than  100  voters  qualified to vote at a general
    7  election in such town of Oyster Bay and who reside within the boundaries
    8  of the proposed district, the town board of the town of Oyster Bay shall
    9  establish by resolution, the date of such election, which date shall not
   10  be later than October 31, [2010] 2011.  The polls shall be open  between
   11  the  hours  of  12:00 Noon to 9:00 p.m. The issues to be decided at such
   12  election shall be:
   13    (a) whether the library funding district authorized by this act  shall
   14  be created on or before January 1, [2010] 2012; and
   15    (b)  whether the initial budget approved by the town board of the town
   16  of Oyster Bay shall be approved or disapproved.
   17    S 2. Subdivision 6 of section 4 of chapter 226 of  the  laws  of  2003
   18  relating  to establishing the Brookville library funding district in the
   19  town of Oyster Bay, county of Nassau, state of New York, as  amended  by
   20  chapter 446 of the laws of 2008, is amended to read as follows:
   21    6.  If  a  majority  of those voting approve both the formation of the
   22  Brookville library funding district and the proposed budget,  then  such
   23  district  shall  be established on the terms and conditions set forth in
   24  this act on or before January 1, [2010] 2012.

    1    S 3. Section 12 of chapter 226 of the laws of 2003 relating to  estab-
    2  lishing  the  Brookville  library funding district in the town of Oyster
    3  Bay, county of Nassau, state of New York, as amended by chapter  446  of
    4  the laws of 2008, is amended to read as follows:
    5    S  12.  This  act  shall  take  effect immediately and shall be deemed
    6  repealed on November 1, [2010] 2011 if the creation  of  the  Brookville
    7  library funding district shall not have been approved before November 1,
    8  [2010]  2011 pursuant to section four of this act provided that the town
    9  clerk of the town of Oyster Bay shall notify the Legislative Bill Draft-
   10  ing Commission  if  the  creation  of  the  Brookville  library  funding
   11  district  shall  not  have  been approved before November 1, [2010] 2011
   12  pursuant to section four of this act in order that  the  commission  may
   13  maintain an accurate and timely effective data base of the official text
   14  of  the  laws  of  the state of New York in furtherance of effecting the
   15  provisions of section 44 of the legislative law and section 70-b of  the
   16  public officers law.
   17    S 4. This act shall take effect immediately.
