STATE OF NEW YORK ________________________________________________________________________ 10186 IN ASSEMBLY March 24, 2020 ___________ Introduced by M. of A. ARROYO -- read once and referred to the Committee on Health AN ACT requiring the department of health to prepare a biennial report on the number of available ventilators at each hospital located within the state The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. a. The department of health shall prepare a report on the 2 number of available ventilators at each hospital located within the 3 state. Such report shall list every hospital and the number of ventila- 4 tors available within each hospital. Such list of hospitals shall be 5 divided into regional groups. For the purpose of this act, "regional 6 groups" shall mean the ten economic development regions established by 7 the New York state department of economic development pursuant to 8 section 230 of the economic development law. 9 b. Such report shall include an analysis on whether the current number 10 of ventilators available within each hospital and within each region are 11 adequate to address a pandemic, epidemic or disease outbreak in which a 12 main symptom is a life-threatening difficulty in breathing that can only 13 be treated with a ventilator. 14 c. Such report shall include the following: 15 (i) the age and life-span of all ventilators; 16 (ii) recommendations on any state expenditures needed to support the 17 purchase of new ventilators in order to replace any out-of-date, non- 18 functioning or poorly functioning ventilators; 19 (iii) recommendations on any funding needed to increase the number of 20 ventilators within the state to meet the needs of a pandemic, epidemic 21 or disease outbreak; 22 (iv) recommendations on the number of trained hospital staff necessary 23 if the number of ventilators is increased in each hospital; and 24 (v) recommendations for training hospital staff to adequately operate 25 such ventilators. 26 § 2. The department of health shall deliver such report to the gover- 27 nor, the speaker of the assembly, the minority leader of the assembly, EXPLANATION--Matter in italics (underscored) is new; matter in brackets [] is old law to be omitted. This act shall take effect immediately.
