          tee on  Local  Governments  --  committee  discharged,  bill  amended,
          ordered reprinted as amended and recommitted to said committee

        AN  ACT  in  relation  to authorizing the village of Freeport, county of
          Nassau, to alienate and discontinue the use of certain parklands

          The People of the State of New York, represented in Senate and  Assem-
        bly, do enact as follows:

     1    Section 1. Subject to the provisions of this act, the village of Free-
     2  port, located in the county of Nassau, acting by and through its village
     3  board and upon such terms and conditions as determined by such board, is
     4  hereby  authorized  to  discontinue  as parklands and alienate the lands
     5  more particularly described in section three of this act no longer need-
     6  ed for park purposes. The provisions of this act  shall  not  extinguish
     7  any existing easements.
     8    § 2. The authorization contained in section one of this act shall take
     9  effect  only upon the condition that the village of Freeport dedicate an
    10  amount equal to or greater than the fair market value of  the  parklands
    11  being  discontinued  towards  the  acquisition  of  new parklands and/or
    12  towards capital  improvements  to  existing  parkland  and  recreational
    13  facilities.
    14    §  3. The parklands authorized by section one of this act to be alien-
    15  ated are described as follows:
    16    ALL that certain plot, piece or parcel of land situate lying and being
    17  in the incorporated village of Freeport, town of  Hempstead,  county  of
    18  Nassau, state of New York and being bounded and described as follows:
    19    BEGINNING  at  a point in the easterly line of Buffalo avenue where it
    20  intersects the northerly boundary line of the "Revised Map  of  Freeport
    21  Centre";
    22    THENCE  North 09 degrees 51 minutes 00 seconds East, 855.32 feet, to a
    23  point;
    24    THENCE South 47 degrees 07 minutes 00 seconds East, 702.48 feet, to  a
    25  point;
    26    THENCE  South 08 degrees 39 minutes 10 seconds West, 500.00 feet, to a
    27  point;

         EXPLANATION--Matter in italics (underscored) is new; matter in brackets

     1    THENCE North 77 degrees 31 minutes 20 seconds  West,  through  Meadow-
     2  brook  State  Park Property and along the northerly line of "Revised Map
     3  of Freeport Centre", a distance of 600.00 feet to the point or place  of
     4  BEGINNING.
     5    Such premises containing 9.218 acres of land.
     6    §  4.  In the event that the village of Freeport received any funding,
     7  support or assistance from the  federal  government  for  the  purchase,
     8  maintenance  or  improvement of the parklands set forth in section three
     9  of this act, the discontinuance and alienation of such parkland  author-
    10  ized  by the provisions of this act shall not occur until the village of
    11  Freeport has complied with any federal requirements  pertaining  to  the
    12  alienation  or  conversion  of  such parklands, including satisfying the
    13  secretary of the interior that the  alienation  or  conversion  complies
    14  with  all conditions which the secretary of the interior deems necessary
    15  to ensure the substitution of other lands shall be  equivalent  in  fair
    16  market value and usefulness to the lands being alienated or converted.
    17    § 5. This act shall take effect immediately.
