AN ACT to amend the education law, in relation to prohibiting product
placement in written, oral, audio or visual assessments, examinations
or other tests
THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
BLY, DO ENACT AS FOLLOWS:
1 Section 1. Section 305 of the education law is amended by adding a new
2 subdivision 52 to read as follows:
3 52. THE COMMISSIONER SHALL PROMULGATE SUCH STANDARDS AND REGULATIONS
4 AS MAY BE NECESSARY TO ENSURE THAT NO STATE OR LOCAL WRITTEN, ORAL,
5 AUDIO, OR VISUAL ASSESSMENT, EXAMINATION OR OTHER TEST SHALL NAME,
6 PICTURE, REFERENCE OR OTHERWISE INCLUDE A PRODUCT, SERVICE, TRADEMARK OR
7 LOGO OR SYMBOL THAT IDENTIFIES OR IS ASSOCIATED WITH SUCH PRODUCT,
8 SERVICE OR TRADEMARK REGARDLESS OF PAYMENT OR OTHER CONSIDERATION
9 PROVIDED TO THE OWNER OF SUCH PRODUCT, SERVICE OR TRADEMARK.
10 S 2. This act shall take effect immediately.
