        AN ACT to amend the  education  law,  in  relation  to  opioid  overdose
          prevention in college housing
          The  People of the State of New York, represented in Senate and Assem-
        bly, do enact as follows:
     1    Section 1. The education law is amended by adding a new section 6438-a
     2  to read as follows:
     3    § 6438-a. Opioid overdose prevention in college housing. 1. Any campus
     4  of the state university of New York, city university of New York or  any
     5  community college shall provide training in the administration of opioid
     6  antagonists  by  a  program  approved under section thirty-three hundred
     7  nine of the public health law to any resident assistant employed by such
     8  campus. Any such  campus  shall  provide  and  maintain  onsite  in  any
     9  college-owned   or  college-operated  housing,  opioid  antagonists,  as
    10  defined in section thirty-three hundred nine of the public  health  law,
    11  in quantities and types deemed by the commissioner, in consultation with
    12  the  commissioner of health. Such opioid antagonists shall be accessible
    13  by each resident assistant for use during emergencies to any student  or
    14  other  individual  on college-owned or college-operated housing premises
    15  suspected of having opioid overdose whether or not there is  a  previous
    16  history of opioid abuse.
    17    2.  Officials  at any campus of the state university of New York, city
    18  university of New York or any community college may designate additional
    19  employees who volunteer to administer opioid antagonists in the event  a
    20  resident  assistant  is  not  physically present at a suspected overdose
    21  incident, provided that such  additional  employee  is  trained  in  the
    22  administration of opioid antagonists by a program approved under section
    23  thirty-three hundred nine of the public health law.
    24    3.  Any person shall not be liable for any act or omission related to,
    25  or any harm resulting  from,  administration  of  an  opioid  antagonist
    26  pursuant to this section, provided that such person acted reasonably and
    27  in good faith.
    28    § 2. This act shall take effect immediately.
