STATE OF NEW YORK ________________________________________________________________________ 9604 IN ASSEMBLY March 22, 2016 ___________ Introduced by M. of A. GIGLIO, GRAF -- read once and referred to the Committee on Insurance AN ACT to amend the insurance law, in relation to requiring health insurance coverage for substance use disorder treatment services The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Paragraph 30 of subsection (i) of section 3216 of the 2 insurance law, as added by chapter 41 of the laws of 2014, is amended by 3 adding a new subparagraph (D) to read as follows: 4 (D) Coverage provided under this paragraph for detoxification, shall 5 be at a minimum, seven days. Rehabilitation services shall be, at a 6 minimum, thirty days. 7 § 2. Subparagraph (D) of paragraph 31 of subsection (i) of section 8 3216 of the insurance law, as amended by chapter 41 of the laws of 2014, 9 is relettered subparagraph (E) and a new subparagraph (D) is added to 10 read as follows: 11 (D) Coverage provided under this paragraph for detoxification, shall 12 be at a minimum, seven days. Rehabilitation services shall be, at a 13 minimum, thirty days. 14 § 3. Paragraph 6 of subsection (l) of section 3221 of the insurance 15 law is amended by adding a new subparagraph (D) to read as follows: 16 (D) Coverage provided under this paragraph for detoxification, shall 17 be at a minimum, seven days. Rehabilitation services shall be, at a 18 minimum, thirty days. 19 § 4. Subparagraph (D) of paragraph 7 of subsection (l) of section 3221 20 of the insurance law is relettered subparagraph (E) and a new subpara- 21 graph (D) is added to read as follows: 22 (D) Coverage provided under this paragraph for detoxification, shall 23 be at a minimum, seven days. Rehabilitation services shall be, at a 24 minimum, thirty days. 25 § 5. Paragraph 3 of subsection (k) of section 4303 of the insurance 26 law, as amended by chapter 41 of the laws of 2014, is renumbered para- 27 graph 4 and a new paragraph 3 is added to read as follows: EXPLANATION--Matter in italics (underscored) is new; matter in brackets [] is old law to be omitted.
