       AN ACT to amend the vehicle and traffic law, in  relation  to  providing
         for the designation of veterans on drivers' licenses
         THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section 1.  Subdivision 1 of section 502 of the  vehicle  and  traffic
    2  law,  as  amended  by  section 2 of part CC of chapter 58 of the laws of
    3  2011, is amended to read as follows:
    4    1. Application for license. Application for a driver's  license  shall
    5  be  made to the commissioner. The fee prescribed by law may be submitted
    6  with such application. The applicant shall furnish such proof of identi-
    7  ty, age, and fitness as may be required by the commissioner. The commis-
    8  sioner may also provide that the application procedure shall include the
    9  taking of a photo image or images of the applicant  in  accordance  with
   10  rules  and  regulations prescribed by the commissioner. In addition, the
   11  commissioner also shall require that the applicant provide  his  or  her
   12  social  security number and provide space on the application so that the
   13  applicant may register in the New York  state  organ  and  tissue  donor
   14  registry under section forty-three hundred ten of the public health law.
   15  FURTHERMORE,  THE COMMISSIONER SHALL PROVIDE SPACE ON THE APPLICATION SO
   16  THAT THE APPLICANT MAY, UPON SUBMISSION OF A COPY OF HIS OR HER DD  FORM
   17  214,  APPLY FOR NOTATION ON SUCH APPLICANT'S LICENSE AS A VETERAN OF THE
   18  ARMED FORCES OF THE UNITED STATES.  In  addition,  an  applicant  for  a
   19  commercial  driver's license who will operate a commercial motor vehicle
   20  in interstate commerce shall  certify  that  such  applicant  meets  the
   21  requirements  to  operate  a  commercial  motor vehicle, as set forth in
   22  public law 99-570, title XII, and title 49 of the code of federal  regu-
   23  lations,  and all regulations promulgated by the United States secretary
   24  of transportation under the hazardous materials transportation  act.  In
   25  addition,  an applicant for a commercial driver's license shall submit a
   26  medical certificate at such intervals as required by the  federal  motor
   27  carrier safety improvement act of 1999 and Part 383.71(h) of title 49 of
   28  the code of federal regulations relating to medical certification and in

    1  a  manner  prescribed  by the commissioner. For purposes of this section
    2  and sections five hundred three and five hundred ten-a  of  this  title,
    3  the  term  "medical  certificate"  shall  mean  a  form substantially in
    4  compliance  with the form set forth in Part 391.43(h) of title 49 of the
    5  code of federal regulations. Upon a determination that the holder  of  a
    6  commercial  driver's  license has made any false statement, with respect
    7  to the application for such license, the commissioner shall revoke  such
    8  license.
    9    S  2. Paragraph (a) of subdivision 1 of section 504 of the vehicle and
   10  traffic law, as separately amended by chapters 568 and 639 of  the  laws
   11  of 2006, is amended to read as follows:
   12    (a)  Every  license  or renewal thereof shall contain a distinguishing
   13  mark and adequate space upon  which  an  anatomical  gift,  pursuant  to
   14  section  forty-three hundred ten of the public health law, by the licen-
   15  see shall be recorded and shall contain such other information and shall
   16  be issued in such form as the commissioner  shall  determine;  provided,
   17  however,  every  license or renewal thereof issued to a person under the
   18  age of twenty-one years shall have prominently  imprinted  upon  it  the
   19  statement  "UNDER  21  YEARS  OF  AGE"  in  notably distinctive print or
   20  format; PROVIDED, FURTHER, THAT EVERY LICENSE OR RENEWAL THEREOF  ISSUED
   21  TO A PERSON WHO PROVIDES SUCH PROOF, AS THE COMMISSIONER SHALL DETERMINE
   22  TO BE SUITABLE INCLUDING A DD FORM 214, THAT SUCH PERSON IS A VETERAN OF
   23  THE  ARMED  FORCES OF THE UNITED STATES SHALL HAVE PROMINENTLY IMPRINTED
   24  UPON IT THE STATEMENT "U.S. VETERAN"; provided further,  however,  every
   25  license  or renewal thereof issued to a person making an anatomical gift
   26  shall have prominently printed upon the front of such license or renewal
   27  thereof the statement "ORGAN DONOR"  in  notably  distinctive  print  or
   28  format. The commissioner shall not require fees for the issuance of such
   29  licenses or renewals thereof to persons under twenty-one years of age or
   30  to  persons  making an anatomical gift which are different from the fees
   31  required for the issuance of licenses or  renewals  thereof  to  persons
   32  twenty-one  years  of age or over or to persons not making an anatomical
   33  gift.
   34    S 3.  This act shall take effect on the first of January next succeed-
   35  ing the date on which it shall have become a law.
