COOK, CRESPO, GIBSON, GOTTFRIED, MAYER- SOHN, WEISENBERG -- read once and referred to the Committee on Econom- ic Development, Job Creation, Commerce and Industry -- recommitted to the Committee on Economic Development, Job Creation, Commerce and Industry in accordance with Assembly Rule 3, sec. 2 -- committee discharged, bill amended, ordered reprinted as amended and recommitted to said committee AN ACT to amend the general business law, in relation to requiring translation of examinations for the license to practice cosmetology into Spanish, Russian, French, or Chinese THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: 1 Section 1. Subdivision 3 of section 407 of the general business law, 2 as added by chapter 509 of the laws of 1992, is amended to read as 3 follows: 4 3. Examinations shall be in the English language [and], SHALL BE 5 TRANSLATED INTO FRENCH, SPANISH, RUSSIAN, OR CHINESE IF REQUESTED BY THE 6 PROSPECTIVE APPLICANT AT THE TIME THE APPLICATION FOR LICENSE IS FILED, 7 OR, at the discretion of the secretary, may be translated or transposed 8 into any other language if requested by the prospective applicant and 9 upon satisfactory proof of the need therefor provided that a request for 10 such a translated examination is made of the secretary at the time the 11 application for license is filed. In the case of physically disabled 12 persons, provision for the alternative administration of the examination 13 may be made, provided a request for such procedure is made of the secre- 14 tary a reasonable time in advance of the examination. Examinations shall 15 be held at least quarterly and shall be given in at least four conven- 16 ient places in the state. Subdivision 3 of section 409 of the general business law, as 2 amended by section 9 of part B of chapter 411 of the laws of 1999, is 3 amended to read as follows: 4 3. The secretary shall receive a non-refundable examination fee of 5 fifteen dollars from each person who takes a written examination pursu- 6 ant to this article. THE SECRETARY, IN HIS OR HER DISCRETION, MAY 7 COLLECT AN ADDITIONAL FEE FROM EACH PERSON WHO REQUESTS THE TRANSLATION 8 OF THE EXAMINATION INTO ANY LANGUAGE OTHER THAN THE ENGLISH LANGUAGE 9 PURSUANT TO SUBDIVISION THREE OF SECTION FOUR HUNDRED SEVEN OF THIS 10 ARTICLE, PROVIDED THAT IN NO EVENT SHALL THE ADDITIONAL FEE EXCEED 11 FIFTEEN DOLLARS. Fees collected pursuant to this article shall be depos- 12 ited to the credit of the business and licensing services account estab- 13 lished pursuant to the provisions of section ninety-seven-y of the state 14 finance law. 15 S 3. This act shall take effect immediately.
