Bill Title: Provides that the commissioner of health shall compile and simultaneously report in a timely manner to the governor, the speaker of the assembly and the temporary president of the senate, health care data related to declared health emergencies including, but not limited to, the number of cases related to such health emergency that originate in nursing, adult and residential health care facilities that are transferred to hospitals and any deaths associated with such cases; and the reason a patient was admitted or visiting a hospital, nursing, adult or residential health care facility when the patient tested positive for or was affected by the declared health emergency; makes related provisions.

STATE OF NEW YORK ________________________________________________________________________ 9202 IN ASSEMBLY February 9, 2022 ___________ Introduced by M. of A. CAHILL -- read once and referred to the Committee on Health AN ACT to amend the public health law, in relation to the disclosure of certain health information during a declared health emergency The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. The public health law is amended by adding a new section 2 206-c to read as follows: 3 § 206-c. Disclosure of certain health information during a declared 4 health emergency. The commissioner shall compile and report in a timely 5 manner simultaneously to the governor, the speaker of the assembly and 6 the temporary president of the senate, health care data related to 7 declared health emergencies including, but not limited to, the number of 8 cases related to such health emergency that originate in nursing, adult 9 and residential health care facilities that are transferred to hospitals 10 and any deaths associated with such cases; number of cases related to 11 such health emergency that originate in hospitals and transferred to 12 nursing, adult or residential health care facilities and any deaths 13 associated with such cases; and the reason a patient was admitted or 14 visiting a hospital, nursing, adult or residential health care facility 15 when the patient tested positive for or was affected by the declared 16 health emergency. All such information shall include new and cumulative 17 data. All personally identifiable health information shall be kept 18 confidential. The commissioner shall also update the same information on 19 the department's website that is downloadable in spreadsheet format, 20 organized according to county and date. 21 § 2.
