DiPIETRO -- read once and referred to the Commit- tee on Education AN ACT to amend the education law, in relation to increasing the amount of the salary paid to any career and technical education teacher, supervisor or other employee of a program of the board of cooperative education services that is considered to be an approved expense for purposes of state allocation THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: 1 Section 1. Paragraph b of subdivision 5 of section 1950 of the educa- 2 tion law, as amended by section 80-a of part A of chapter 58 of the laws 3 of 2011, is amended to read as follows: 4 b. The cost of services herein referred to shall be the amount allo- 5 cated to each component school district by the board of cooperative 6 educational services to defray expenses of such board, except that that 7 part of the salary paid any teacher, supervisor or other employee of the 8 board of cooperative educational services which is in excess of thirty 9 thousand dollars shall not be such an approved expense, and except also 10 that administrative and clerical expenses shall not exceed ten percent 11 of the total expenses for purposes of this computation. PROVIDED HOWEV- 12 ER, THAT BEGINNING IN THE TWO THOUSAND FOURTEEN-TWO THOUSAND FIFTEEN 13 SCHOOL YEAR, THAT PART OF THE SALARY PAD TO ANY CAREER AND TECHNICAL 14 EDUCATION TEACHER, SUPERVISOR OR OTHER EMPLOYEE OF A PROGRAM OF THE 15 BOARD OF COOPERATIVE EDUCATIONAL SERVICES WHICH IS IN EXCESS OF THIRTY- 16 SIX THOUSAND DOLLARS SHALL NOT BE SUCH AN APPROVED EXPENSE; BEGINNING IN 17 THE TWO THOUSAND FIFTEEN-TWO THOUSAND SIXTEEN SCHOOL YEAR, THAT PART OF 18 THE SALARY PAID TO ANY CAREER AND TECHNICAL EDUCATION TEACHER, SUPERVI- 19 SOR OR OTHER EMPLOYEE OF A BOARD OF COOPERATIVE EDUCATIONAL SERVICES 20 WHICH IS IN EXCESS OF FORTY-TWO THOUSAND DOLLARS SHALL NOT BE SUCH AN 21 APPROVED EXPENSE; BEGINNING IN THE TWO THOUSAND SIXTEEN-TWO THOUSAND 22 SEVENTEEN SCHOOL YEAR, THAT PART OF THE SALARY PAID ANY CAREER AND TECH- 23 NICAL EDUCATION TEACHER, SUPERVISOR OR OTHER EMPLOYEE OF THE BOARD OF 24 COOPERATIVE EDUCATIONAL SERVICES WHICH IS IN EXCESS OF FORTY-EIGHT THOU- 25 SAND DOLLARS SHALL NOT BE SUCH AN APPROVED EXPENSE; BEGINNING IN THE TWO EXPLANATION--Matter in ITALICS (underscored) is new; matter in brackets [ ] is old law to be omitted. LBD14459-01-4 A. 9183 2 1 THOUSAND SEVENTEEN-TWO THOUSAND EIGHTEEN SCHOOL YEAR, THAT PART OF THE 2 SALARY PAID ANY CAREER AND TECHNICAL EDUCATION TEACHER, SUPERVISOR OR 3 OTHER EMPLOYEE OF THE BOARD OF COOPERATIVE EDUCATIONAL SERVICES WHICH IS 4 IN EXCESS OF FIFTY-FOUR THOUSAND DOLLARS SHALL NOT BE SUCH AN APPROVED 5 EXPENSE AND PROVIDED FURTHER BEGINNING IN THE TWO THOUSAND EIGHTEEN-TWO 6 THOUSAND NINETEEN SCHOOL YEAR AND THEREAFTER, THE ACTUAL SALARY OR THE 7 AVERAGE STATEWIDE SALARY AS ESTABLISHED BY THE COMMISSIONER, WHICHEVER 8 IS LESS, SHALL BE PAID FOR ANY CAREER AND TECHNICAL EDUCATION TEACHER, 9 SUPERVISOR OR OTHER EMPLOYEE OF THE BOARD OF COOPERATIVE EDUCATIONAL 10 SERVICES; PROVIDED FURTHER THAT BEGINNING IN THE TWO THOUSAND FOURTEEN- 11 -TWO THOUSAND FIFTEEN SCHOOL YEAR AND EVERY YEAR THEREAFTER, THE COST OF 12 SERVICES PROVIDED BY ANY CAREER AND TECHNICAL EDUCATION TEACHER, SUPER- 13 VISOR OR OTHER EMPLOYEE OF THE BOARD OF COOPERATIVE EDUCATIONAL SERVICES 14 THAT IS CERTIFIED BY THE COMMISSIONER TO BE OF SUFFICIENT RIGOR TO MEET 15 NATIONAL STANDARDS SHALL BE ONE HUNDRED PERCENT OF SUCH SALARY OR THE 16 AVERAGE STATEWIDE SALARY, WHICHEVER IS LESS AS DETERMINED BY THE COMMIS- 17 SIONER. Any gifts, donations or interest earned by the board of cooper- 18 ative educational services or on behalf of the board of cooperative 19 educational services by the dormitory authority or any other source 20 shall not be deducted in determining the cost of services allocated to 21 each component school district. Any payments made to a component school 22 district by the board of cooperative educational services pursuant to 23 subdivision eleven of section six-p of the general municipal law attrib- 24 utable to an approved cost of service computed pursuant to this subdivi- 25 sion shall be deducted from the cost of services allocated to such 26 component school district. The expense of transportation provided by 27 the board of cooperative educational services pursuant to paragraph q of 28 subdivision four of this section shall be eligible for aid apportioned 29 pursuant to subdivision seven of section thirty-six hundred two of this 30 chapter and no board of cooperative educational services transportation 31 expense shall be an approved cost of services for the computation of aid 32 under this subdivision. Transportation expense pursuant to paragraph q 33 of subdivision four of this section shall be included in the computation 34 of the ten percent limitation on administrative and clerical expenses. 35 S 2. This act shall take effect immediately.
