STATE OF NEW YORK ________________________________________________________________________ 8866--A 2017-2018 Regular Sessions IN ASSEMBLY December 22, 2017 ___________ Introduced by M. of A. THIELE -- read once and referred to the Committee on Transportation -- recommitted to the Committee on Transportation in accordance with Assembly Rule 3, sec. 2 -- committee discharged, bill amended, ordered reprinted as amended and recommitted to said commit- tee AN ACT to amend the vehicle and traffic law, in relation to authorizing the issuance of distinctive license plates for gold star fathers The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Section 404-i of the vehicle and traffic law, as amended by 2 chapter 277 of the laws of 1991, subdivision 1 as amended by chapter 732 3 of the laws of 2004, subdivision 3 as amended by chapter 486 of the laws 4 of 1996 and such section as renumbered by chapter 108 of the laws of 5 1994, is amended to read as follows: 6 § 404-i. Distinctive plates for gold star mothers and gold star 7 fathers. 1. Any gold star mother or gold star father or the spouse of a 8 gold star mother or gold star father, residing in this state shall, upon 9 request, be issued a license plate bearing the words "gold star mother" 10 or "gold star father", respectively. If a distinctive plate is issued 11 to a gold star mother or gold star father pursuant to this section, 12 additional distinctive plates may be issued for every vehicle registered 13 in the name of the gold star mother or gold star father recipient resid- 14 ing in this state or the spouse of such gold star mother or gold star 15 father. Application for said license plate shall be filed with the 16 commissioner in such form and detail as the commissioner shall 17 prescribe. 18 2. The distinctive plate authorized herein shall be issued upon proof, 19 satisfactory to the commissioner, that the applicant or the spouse of 20 the applicant is a gold star mother or gold star father. 21 3. A distinctive plate issued pursuant to this section shall be issued 22 in the same manner as other number plates upon payment of the regular EXPLANATION--Matter in italics (underscored) is new; matter in brackets [] is old law to be omitted. LBD13823-02-8A. 8866--A 2 1 registration fee prescribed by section four hundred one of this article, 2 provided, however, that no service charge shall be charged for such 3 plate. 4 § 2. 1. A distinctive gold star father plate established pursuant to 5 section 404-i of the vehicle and traffic law shall only be designed, 6 produced and issued upon the delivery to the department of motor vehi- 7 cles of a surety bond in the amount of six thousand dollars, which shall 8 be executed by a surety company authorized by the department of finan- 9 cial services to transact business in this state. Provided, however, 10 that if the commissioner of motor vehicles shall have received prior to 11 plate design, production and issuance at least two hundred orders for 12 such distinctive plate together with the additional annual service 13 charge applicable to each such order, which shall be non-refundable, no 14 such surety bond shall be required. All service charges collected pursu- 15 ant to this section shall be deposited pursuant to the provisions of 16 section 404-oo of the vehicle and traffic law to the credit of the 17 department of motor vehicles distinctive plate development fund estab- 18 lished by section 95-g of the state finance law and shall be used for 19 the design, production, advertising and distribution of distinctive 20 license plates in accordance with such section 95-g. 21 2. If, upon the expiration of two years following the date upon which 22 distinctive plates in the series are first available for sale two 23 hundred or more sets of such plates are sold, a bond delivered pursuant 24 to this section shall be discontinued. If fewer than two hundred sets of 25 such plates are sold by such time, the department of motor vehicles 26 shall be entitled to recover against the bond in an amount proportionate 27 to such shortfall. 28 § 3. This act shall take effect immediately; provided, however, that 29 section one of this act shall take effect on the one hundred eightieth 30 day after it shall have become a law. Effective immediately, the addi- 31 tion, amendment and/or repeal of any rule or regulation necessary for 32 the implementation of this act on its effective date are authorized to 33 be made and completed on or before such effective date.
