       AN ACT to amend the public health law, in relation  to  public  hearings
         for hospital operating certificates
         THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section 1. Subdivision 3 of section 2806 of the public health law,  as
    2  amended  by  chapter  105  of  the  laws  of 1977, is amended to read as
    3  follows:
    4    3. The commissioner shall fix  a  time  and  place  for  the  hearing,
    5  PROVIDED  THAT  NO  SUCH HEARING SHALL BEGIN BEFORE 6 P.M. A copy of the
    6  charges, together with the notice of the time and place of the  hearing,
    7  shall  be  served in person or mailed by registered or certified mail to
    8  the hospital at least ten days before the date fixed  for  the  hearing.
    9  The  hospital  shall  file  with the department not less than three days
   10  prior to the hearing a written answer to the charges.
   11    S 2. This act shall take effect on the sixtieth  day  after  it  shall
   12  have become a law.
