       AN  ACT  to amend the transportation law, in relation to authorizing the
         commissioner of transportation to provide for an alternative system of
         inspection of certain vehicles
         THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section  1.  Subdivision 33 of section 14 of the transportation law is
    2  amended by adding a new paragraph (c) to read as follows:
    3    (C) THE COMMISSIONER SHALL PROMULGATE RULES AND REGULATIONS  PROVIDING
    4  FOR  AN  ALTERNATIVE  SYSTEM  OF  INSPECTION OF SUCH VEHICLES ON-SITE AT
    5  DEPOTS AND OTHER APPROVED FACILITIES, INCLUDING A FEE SCHEDULE FOR  SUCH
    6  ON-SITE  INSPECTION REGIMEN AND THE ISSUANCE OF A CERTIFICATE OF COMPLI-
    7  ANCE THAT, UPON DISPLAY DURING A ROADSIDE INSPECTION, WILL  EXEMPT  SUCH
    8  VEHICLES FROM SUCH ROADSIDE INSPECTION.
    9    S  2. Paragraph (c) of subdivision 2 of section 140 of the transporta-
   10  tion law, as amended by chapter 602 of the laws of 1985, is  amended  to
   11  read s follows:
   12    c. The department shall have the power to examine vehicles, facilities
   13  and  records  subject to the provisions of this subdivision, at any time
   14  and place where they are found, to  ascertain  whether  such  rules  and
   15  regulations  are  being obeyed. The rules and regulations of the commis-
   16  sioner shall provide for the inspection of all  such  vehicles  at  such
   17  periods  and  at  such  manner as the commissioner may direct, and, when
   18  adopted, shall have the full force and effect of law.   SUCH  RULES  AND
   19  REGULATIONS  SHALL  ALSO PROVIDE FOR AN ALTERNATIVE SYSTEM OF INSPECTION
   20  OF SUCH VEHICLES  ON-SITE  AT  DEPOTS  AND  OTHER  APPROVED  FACILITIES,
   21  INCLUDING  A  FEE  SCHEDULE  FOR SUCH ON-SITE INSPECTION REGIMEN AND THE
   22  ISSUANCE OF A CERTIFICATE OF COMPLIANCE  THAT,  UPON  DISPLAY  DURING  A
   23  ROADSIDE  INSPECTION,  WILL  EXEMPT  SUCH  VEHICLES  FROM  THE  ROADSIDE
   24  INSPECTION.
   25    S 3. This act shall take effect immediately.
