STATE OF NEW YORK ________________________________________________________________________ 8003 2021-2022 Regular Sessions IN ASSEMBLY June 4, 2021 ___________ Introduced by M. of A. MIKULIN -- read once and referred to the Commit- tee on Education AN ACT to amend the education law, in relation to prohibiting individ- uals serving on a school or library board of trustees from resigning from their current term in order to run for a vacant trustee position The People of the State of New York, represented in Senate and Assem- bly, do enact as follows: 1 Section 1. Section 2105 of the education law is amended by adding a 2 new subdivision 15 to read as follows: 3 15. Notwithstanding any other law to the contrary, any individual 4 currently serving as a trustee of a common school district, central 5 school district or union-free school district shall be prohibited from 6 resigning his or her current position as trustee in order to run for a 7 vacant trustee position and shall only be eligible to run for a vacant 8 trustee position once his or her current term has expired. Any vacant 9 trustee position shall be filled in accordance with section two thousand 10 one hundred thirteen of this part. 11 § 2. Section 260 of the education law is amended by adding a new 12 subdivision 7-a to read as follows: 13 7-a. Any individual serving on the board of trustees of a public 14 library shall be prohibited from resigning his or her current position 15 as trustee in order to run for a vacant trustee position and shall only 16 be eligible to run for a vacant trustee position once his or her current 17 term has expired. 18 § 3.
