PERRY -- read once and referred to the Committee on Transportation AN ACT to amend the railroad law, in relation to the promulgation of standards for private railroad crossings in an inter city passenger service corridor and in a commuter rail service corridor THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM- BLY, DO ENACT AS FOLLOWS: 1 Section 1. Subdivision 4 of section 97 of the railroad law, as added 2 by chapter 515 of the laws of 1994, is amended to read as follows: 3 4. The commissioner shall prepare and promulgate standards and spec- 4 ifications for the design and protection of private rail crossings in an 5 intercity rail passenger service corridor and [is authorized to] SHALL, 6 ON OR BEFORE JUNE THIRTIETH, TWO THOUSAND FOURTEEN, adopt and promulgate 7 such rules and regulations DEEMED NECESSARY to [accomplish this as shall 8 be deemed necessary] IMPLEMENT THE PROVISIONS OF THIS SECTION. EXCEPT AS 9 OTHERWISE PROVIDED BY LAW, SAID RULES AND REGULATIONS SHALL: (A) INCLUDE 10 GUIDELINES FOR THE ALLOCATION OF RESPONSIBILITY FOR THE COSTS ASSOCIATED 11 WITH THE ESTABLISHMENT OF ANY NEW PRIVATE CROSSINGS PURSUANT TO SUBDIVI- 12 SION TWO OF THIS SECTION OR THE CLOSING OR IMPROVEMENT OF EXISTING 13 PRIVATE CROSSINGS PURSUANT TO SUBDIVISION THREE OF THIS SECTION; (B) 14 RECOGNIZE THAT THE PRIVATE INTERESTS SEEKING OR USING A CROSSING SHALL 15 BE GENERALLY RESPONSIBLE FOR SUCH COSTS, AS WELL AS FOR ALL COSTS ASSO- 16 CIATED WITH THE INSPECTION AND MAINTENANCE OF SUCH IMPROVEMENTS; AND (C) 17 REQUIRE THAT THE ARRANGEMENT BETWEEN THE RAILROAD AND THE OWNERS OR 18 OCCUPANTS OF THE ADJOINING PROPERTIES SHALL BE FORMALIZED IN AN AGREE- 19 MENT. 20 S 2. Subdivision 4 of section 97-a of the railroad law, as added by 21 chapter 230 of the laws of 2002, is amended to read as follows: 22 4. LBD11400-01-3 A. 7897 2 1 itan transportation authority, [is authorized to] SHALL, ON OR BEFORE 2 JUNE THIRTIETH, TWO THOUSAND FOURTEEN adopt and promulgate such rules 3 and regulations [as may be] DEEMED necessary to implement the provisions 4 of this section. Except as otherwise provided by law, said rules and 5 regulations shall include guidelines for the allocation of responsibil- 6 ity for the costs associated with establishment of any new private 7 crossings pursuant to subdivision two of this section or the closing or 8 improvement of existing private crossings pursuant to subdivision three 9 of this section and shall recognize that the private interests seeking 10 or using a crossing shall be generally responsible for such costs as 11 well as all costs associated with the inspection and maintenance of such 12 improvements; and, that the arrangement between the railroad and the 13 owners or occupants of the adjoining properties shall be formalized in 14 an agreement. 15 S 3. This act shall take effect immediately.
