       AN ACT to amend the environmental conservation law, in relation  to  the
         management of land clearing debris in Nassau and Suffolk counties
         THE  PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section 1. The environmental conservation law is amended by  adding  a
    2  new section 27-0721 to read as follows:
    3  S 27-0721. MANAGEMENT  OF  LAND  CLEARING  DEBRIS  IN NASSAU AND SUFFOLK
    4             COUNTIES.
    5    IN NASSAU AND SUFFOLK COUNTIES NO FACILITY SHALL ACCEPT LAND  CLEARING
    6  DEBRIS  COMMERCIALLY UNLESS IT IS IN COMPLIANCE WITH REGULATIONS PROMUL-
    7  GATED BY THE DEPARTMENT TO MINIMIZE ENVIRONMENTAL HARM, INCLUDING  MINI-
    8  MIZING FIRE RISK, SUPPRESSING DUST AND MINIMIZING ODOR.
    9    FOR  THE  PURPOSE  OF  THIS SECTION, "LAND CLEARING DEBRIS" SHALL MEAN
   10  VEGETATIVE MATTER, SOIL AND ROCK RESULTING FROM ACTIVITIES SUCH AS  LAND
   11  CLEARING AND GRUBBING, UTILITY LINE MAINTENANCE OR SEASONAL OR STORM-RE-
   12  LATED CLEANUP SUCH AS TREES, STUMPS, BRUSH AND LEAVES AND INCLUDING WOOD
   13  CHIPS GENERATED FROM THESE MATERIALS.
   14    S  2.  This  act shall take effect on the ninetieth day after it shall
   15  have become a  law.  Effective  immediately,  the  addition,  amendment,
   16  and/or  repeal  of any rule or regulation is authorized to be made on or
   17  before such effective date.
