       AN  ACT to amend the education law, in relation to authorizing access to
         students' individualized education program electronically
         THE PEOPLE OF THE STATE OF NEW YORK, REPRESENTED IN SENATE AND  ASSEM-
       BLY, DO ENACT AS FOLLOWS:
    1    Section  1. Paragraph a of subdivision 7 of section 4402 of the educa-
    2  tion law, as added by chapter 408 of the laws of  2002,  is  amended  to
    3  read as follows:
    4    a.  The board of education or trustees of each school district and the
    5  board of trustees of each charter school shall adopt a policy to  ensure
    6  that  each regular education teacher, special education teacher, related
    7  service provider, and other service provider who is responsible for  the
    8  implementation  of a student's individualized education program shall be
    9  given a copy of such student's individualized education program prior to
   10  the implementation of such program OR  SHALL  BE  ABLE  TO  ACCESS  SUCH
   11  STUDENT'S  INDIVIDUALIZED  EDUCATION  PROGRAM  ELECTRONICALLY; PROVIDED,
   12  HOWEVER, INDIVIDUALS RESPONSIBLE FOR THE IMPLEMENTATION OF  A  STUDENT'S
   13  INDIVIDUALIZED EDUCATION PROGRAM SHALL BE NOTIFIED ON HOW TO ACCESS SUCH
   14  INDIVIDUALIZED EDUCATION PROGRAMS ELECTRONICALLY.
   15    S 2. This act shall take effect immediately.
